Can I get defaults removed from IVA commencement date ?

Hi,

I entered into an IVA in 2008 and managed to settle this early in 2011. Whilst paying my IVA a few creditors registered defaults every month on my credit file is this correct? also some didn't regiter any and now that i have settled they have started putting default on there, is this correct?

Can i get the defaults removed from IVA commencement date?

Can i get them removed from settlement date?

Or do i have to wait 6 years to do anything?

You can write to your creditors and ask them to change the defaults listed to your IVA approval date. However, these will still remain on your file for a full 6 years. If you get the default dates changed now, then on the 6th anniversary in 2014, they will drop off automatically.

Hi Pete

If creditors register a default after our IVA approval you can write to them and request the deafults be ammended to the date the IVA was approved.

If they do not you can write to the Information Commissioner enclosing your IVA documentation and your letter to the creditor requesting they update the credit file.

KAYKAY is correct all defaults will remain for 6years so it is important they are entered on the correct date.

As the IVA will be on file until 2014 you have time to work through your file,sorting any errors,like defaults dated later than the IVA start date.

Make sure letters are sent recorded delivery as the ICO will need proof that you have given the offending creditors an opportunity to correct things before they take any action.
