ive recently had an iva failed because i moved to belgium ( uk armed forces) so when i was told i asked to be put on another iva and the company Blair Endersby have now told me that i cannot. now the point im making is i wasnt told that if i move abroad the iva would fail, so can u please advise me on where i stand because as of now my creditors are coming back to me trying to take me to court after twos years of being in an ive

Hi matto4 and welcome to the forum

I cannot believe that your IVA has failed due to a relocation. If you have been adised this, to be honest you have received very poor advice. I have a number of people in the Armed Forces who I am acting for (I'm ex forces myself!) and they happily pay their contributions from far and wide.

Can you give us some more details about this please?

If Blair Endersby have indeed failed your IVA for the sole reason of you moving abroad then it seems to me that they themselves have broken the terms of the arrangement (unless there's a clause in the IVA forbidding you from moving abroad - unlikely), and you might want to invite them via a solicitor's letter to assume responsibility for all the debts that you had in the IVA which have now been resurrected by the failure of the IVA.

I did the opposite I started an IVA in Belgium then moved back to UK, But please be advised if you start up your IVA again in Belgium they will expect you to pay a big majority of your LOA into your IVA, I would have thought you creditors would be very happy for you to move abroad for this reason

The IVA was not failed as Matt moved to Belgium.

As he now lives in Belgiumm, with no ascertainable base in England or Wales, he can not do an IVA as his centre of main interest is in another EC country and I have had this confirmed by a Deputy High Court Bankruptcy Registrar and a respected personal insolnecy barrister.
We too have many clients paying from abroad and his location was not an issue with regards to the failure.

I don't agree with the Judge! British soldiers have UK domicilary rights whereever they serve in the world - I know this because I used to be one! - and an application can be made in the High Court.

Does anyone else feel slightly uncomfortable with this poster's personal situation being discussed so explicitly by their IP company? I raise the point as I know in another thread concerns were expressed by Forum members regarding their identities being revealed or recognised by their IP firm. Perhaps this is something that needs to be considered at an early stage as I think it's important that we maintain Forum member's anonymity and trust in being able to post what they need to without fear if their identities being revealed.

I was suprised when I read the post, as I do not feel it was appropriate to confirm the nature of the breach. I just hope that Matt has been able to log on and read my post, as there is still hope for him in my opinion if he wants to have another go.

Whilst a lot of my clients use the forum, I would never disclose any details of their cases - unless it was initiated by them.

I often tell people to contact me off line if I feel that there is a chance that unecessary information might be disclosed.

I agree Quark. I'm glad I'm not with them. I would hate someone to post something about my IVA which I hadn't mentioned, on here.

I agree, I was a bit shocked by this thread, I don't blame Matt if he never posts again. I also agree with Marie, on BE's earlier post they state they want to help their clients but no mention of just helping everyone in general, as Melanie, Ian, Paul and Size5 do. How will that work, will they just pick up the posts that mention their name?

Thats shocked me too. I'm all for having more IPs on the forum it can be a very useful thing but i think it was a bit unfair to give out so much personal information on a forum that allows you to remain annonymous.

Well if you google "blair endersby abroad" the 2nd link that comes up is this topic!! (1st link is another IVA.co.uk post!)

I guess maybe Matt shouldnt have used his IP companies name!. I for one have never revealed my IP companies name on here!

If an IVA companies name is revealed on here,how far do we feel they have a right to defend themselves??

out of the 4 posts BE have posted, 2 related to their clients,and 2 were just to help people with general questions..so they havent just defended themselves!

As Melanie has said before, we should all be careful what we divulge on here,as you never know who is watching....Google is for one!!!!
