can you only enter IVA before a CCJ is registered

If someone has a CCJ against their name for a debt and that person wants to pay some of that debt off but unable to pay it all, can s/he enter into an IVA or can you only enter an IVA before a CCJ is registered?

You can enter into an IVA after a CCJ has been approved as the debt will still be unsecured. If you own a property and you have a court approved charging order attached to the property then this particular debt could no longer be included as it would have become secured.

Hi lh and Welcome,

A CCJ must be included in the IVA, the monthly payment can be paid right up to the IVA being approved. Once the IVA is approved the CCJ will then become overwritten by the IVA.
