CHARGE ON OVERSEAS PROPERTY

Hi ALL

My IP did not place a charge on my property in Spain, if they had done then my lawyers who are acting for me in litigation would have found out and i would not be in trouble with them.
As it happens my lawyers no longer want to act for me as a result of going in to an IVA, why didnt the IP place a charge on the property?
as i thought this was normal practice

Hi Amanda

A Supervisor of an IVA is not allowed to register a charge over your property. The only thing which can be done is to register a restriction, which merely gives them knowledge if you attempt to dispose of the property. There may be different laws in Spain, so I could not comment, but it would be even more difficult for your IP to register an interest when IVA's are probably not recognised in Spain.
