Ashenton, you can claim it back, but it will be paid straight into your IVA -- the creditors will benefit from a higher dividend, but you will get nothing in your pocket.

If you are happy for your creditors to get a higher dividend then go for it but as Foggy says, you will receive nothing.

My PPI was written into my IVA when it was set up as it was one that refunded all premium paid at the 5 years stage if no claims had been made.
Barclays sent me the form to claim refund, it was completed and sent in, they refunded me by cheque and it was paid to my IP once cleared in my bank account. (It was very nice to see my bank account looking very healthy for a week -- the first time in about 4 years it has done)
If it was not for the IVA is was going to help replace the car and bike.
Will also be getting a life insurance one which was going to be a nice holiday when I am 50 (in a couple of years time) but will also be getting paid into the IVA.

If your PPI was sold to you by a Bank, they have all finally agreed to contact all PPI customers to see if they were mis-sold. They have set aside £2.5 billion to cover this, and so far have actually paid out £215 million. Barclays are not even checking if the customer was mis-sold. It's cheaper for them to just pay out anyone who complains !
Why not check how long you have during which to claim, and then if possible wait until your IVA ends, and then claim.
thanks for some of the comments, to clarify i went to a debt mangement company whom set me up with a company to deal with my IVA and another company to deal with my ppi - which was advised as a way toreduce my overall debt. iam not looking to get the money back only the reassuarnce that any fees are covered.Do i have a choice to reject the offer as the ppi company state they will charge 28% for an offer if i accept or not??
Am i best speaking to the credit card company and asking for the claim to be withdrawn or am i then still legaly responsible for fee with the claim company?.If i had known this would have happened then obviously i would not have pursued in December when setting all this up, but you are trusting you assume the experts.
this cannot be the first time this occurred with these companies?.

I tried about getting the PPI back
I was told by the people I contacted to let them know when I got the IVA finsihed as I had 6 years to make a claim I told this story to my IVA company guys and they told me to wait until I completed my IVA also as its classed as a windfall so you can get the PPI back but you have to pay it across towards the IVA so they are giving you the money and then taking it back what you paid them in the first place : )
At least it means that your creditors are getting a better dividend.
After all, they have written off a proportion of your debts and stopped all interest and charges so I think it's a bit of a cheek to try and claim PPI back.

You may find that the IP company insist on the claim still going through as we have had posts about that in the past. In that case I think the fees would come from the payout.
Speak to your IP though.
