The Insolvency Register should have been updated at the time of the transfer of files. I suggest that you draw this to the attention of your new firm, as this may be an oversight by either them or the Insolvency Service.

I can understand how you'd feel very agrieved at telling them that you were at that level of income for 2 years and they agreed to help, only to threaten bankruptcy for not being able to continue to make payments!
We are with cleardebt and have been from the start, not abacus or whoever and we were never told to have a bonfire with the paperwork! I imagine that this was said in jest and not as an instruction - which you didn't have to do!
We have had excellenct service from them, a payment reduction to finance the lease of a car, payment break for car repairs etc and cannot endorse them enough.
We have had paperwork from them regarding PPI and have signed and complied regarding claims. To the best of my knowledge we have always opted out as I never believed it to be good anyway. If there are claims then great, we keep the first 500 pounds and the creditors get the rest. Personally, I would feel morally wrong ever taking money from the companies that will have written off literally 10s of thousands of pounds for us so if it pays extra to the IVA, fine.
We have 18 months left and I am hoping that they will be as pain free (ish!!) as the last 42 have been!
For the first year and a half we were very pleased with the service we had, indeed, the helpfulness and patience of all the staff we have dealt with ( including today when I rang them to see if any progress on our issues) have been very good. The main problem we have is the information we were given, which has turned out to be incorrect. Unfortunately for us there has been a few issues which at tbe end of day results us being pushed into a postion where we are faced witb bankruptcy. I am very pleased for you that you were and able to cope with the stress that comes with dealing with debt and the problems that develops with it. I had a breakdown a couple of years before we entered the iva and at no point during the set up of our iva did I feel or even now do I feel that any of the agents I dealt with was being flippant or made jests with me. And surprisingly I didnt have a bonfire but shredded our paperwork. Naive maybe I was by doing this, but as ive never been in this situation before and suffering from depression I followed the advice that was given to me. I wish I was stronger and can cope as well as you but when you find life hard enough to cope with without additional problems then the pit gets even bigger and you feel there's no way out.
As for the ppi claims, we wAnt the creditors to gain from them, not us or IPs if they havent done the work for the claims. We declined the 500 on the basis it should be for the creditors.

please don't get me wrong, if people do the work on your behalf then of course they should be paid. Its just in our case, an agent on behalf of our IP told us (because i believe there was no PPI claims department in place at the time) that we had to deal with our PPI claims and to let them know how we got on. So we took on an agency who only charge 25% to sort it out, unlike our IP claims team who charge 33%. (we have this in writing). We told our claims team that any money awarded to us had to be paid direct to our IP for the benefit of our creditors.
I did all the PPI claims myself too Fritcake without the need for a claims company, the forms are available free from FOS, took alot of hours and cost for stamps/envelopes/printer ink/phone calls, around £75 in all, I did not feel that a Claims company would do anything different of get a different result and we saved 25-35% in fee's.
Took The plunge and made the call, changed our family life and we have never been happier. Debt free and wont go back..... IVA was by far the best thing we ever did to teach us the real value of Family and money
you have managed to save a lot of money for your creditors which is great. i am not well and my husband suffers from stress too. this is one of the reasons why we couldn't deal with it ourselves, plus we didnt have any paperwork and to be fair, when the PPIs claims first came out there wasn't a lot of advise or knowledge as there is now. but this advise is good for anyone who needs to start a claim now, though if in a IVA check with their IP personally first, to make sure they are happy for you to do it yourself.
I am sorry to hear that fruitcake, you are right I think your last point highlights your concern about IP's getting 15%, most IVA companies as we can see from the posts are not giving their clients in an IVA a choice but to use their selected Claims companies full stop, where as some like Mel actively encourage their clients to make the claims themselves so not all IP's are trying to earn from it, on the flip side any work that is carried out for those clients that can't do it themselves needs to be paid for as the IP still need to manage and admin any claims awarded within the IVA. My own experience is that I am happy to be in the position I am in an IVA and protecting my house so if my IP takes a % to manage all that for me still happy days for me. I hope things get better for you Fritcake and hubby too, stress is not a nice thing to deal with.
