Hi there,

I asked a couple of questions yesterday, and dont want to repeat myself but want to make sure everything is in order for me to complete my BR submission.

I confirmed with my IP this morning that i would be going ahead to petition for my own BR as 15 months into my IVA, i cannot afford the payments (mainly due to the 'jigging' about with my expenditure outgoings to make the IVA work!). My IP has cancelled my Direct Debit and will inform all my creditors of my descision.
I now want to press ahead with BR asap (hopefully before my creditors start chasing me again!). I am going to use the money that was going to be my next IVA payment to pay the £485 BR costs, so i should be able to do this when i get paid next week.
I have almost completed the on-line BR forms, but want to just make sure of something first. It says that when you press 'submit', a copy of the forms will be electronically transferred to the Insolvency people, and then i will get new forms back to complete and print off.

Do i need to make an appointment with my local county court (York) before i submit my forms, or can i wait to print off my forms and then make the appointment after? Do my submitted forms go to the head office of the Insolvency register or do they go to the court i wish to attend?
Also, when i started my IVA, i destroyed most of my loan and credit card statements etc (as i never wanted to see them again and didn't think they would be needed!). I did have my complete list of creditors and what i owed and full address etc as i found these on my IVA proposal,so i have completed the details on the on-line application BR, but i do not have all the statements etc. Has anyone else who has been through BR and gone to court also not had all the paperwork? Is this vital or can the OR get all the info from the name and address of each creditor?

Hi Swardy

Best thing to do is to ring up York County Court to see what their actual procedure is. This does change from Court to Court.

Why not ask your IP to e-mail you a current list of all agreed creditor claims. That should be fairly simple for them to do.

swardy you can print the forms as soon as you are ready to, regardless if you have no appointment, print them off 3 times as some courts require 3 copies, otherwise you will end up having to pay for photocopies on the day, make sure you have gone through all your forms over and over, you can leave them there if you wish to until you have your date good luck

Thanks a lot Kerri and Melanie.

I have actually made an appointment at York County Court since my last post. My appointment is 9am on Wed 25th July.
I have fully completed forms, submitted them and printed them off (3 copies - thanks). The only bit that i didn't complete was the Tax Ref number. No-one will give me this over the phone, even when i quote my National Insurance number. They will send letter in post so hopefully i can just write this in when i know it.
I havn't got my creditors statements as i destroyed these when i started my IVA but i was told by the court i wouldn't need these on 25th July, and the OR may speak to me about these. I'm hoping the fact i've got all my creditors names, address's, what i owed and agreement numbers (99% anyway) on my forms will be enough.
I'm so glad i've got my appointment, and hoping it will run as smooth as possible.

Good Luck....i am going to be doing the same thing come 31st of the month..payday for the £485...i'm terrified of the whole process...haven't slept properly for weeks..i'm sure you know what i mean !

I went through it this week - on Tuesday - have a look at my post .
It all went very well, no one was nasty, no one looked at me like I was a criminal ( Im not ) .

On the day I only need 2 copies but it would be wise to take 3 copies, the court is separate from the insolvency service, they didnt want any documents , the OR will want them at some stage but if you dont have them dont worry, just tell them.

Just remember that they are civil servants, just normal folk that work for the govt - still human and not out to get you, you dont owe them any money !

It was a lot less painful that I thought it would be .

like hamish said you all will be fine, the process is very painless, and not at all like you think, the hardest part is handing over the £485.
