Hi there, first post here from an IVA newbie. I am only in month one of my joint IVA with my partner and hope someone can give me some help with a question i have.
At the beginning of last month i was the victim of a violent crime and the person responsible has just been sentanced to 21 months in prison, i have been advised by the court and police that i am eligible to claim compensation through the criminal injuries compensation fund, a government scheme set up to compensate people who have been victims of violent crimes.
I am aware that like nearly everyone in an IVA, all windfall payments have to be declared to my IP. To be honest i'm not looking to make huge amounts but have also been advised that i could receive upto £2000 payout. As this is a personal injury compensation payout would it all go to my creditors or would part be distributed to them.
Any help on the matter would be greatly received.

I don't know the answer to this question as I'm not even in my IVA yet! But I just wanted to say I'm so sorry to hear about your troubles, I hope you are recovering.

Hi tim hope things are getting easier now your attacker has been put away. Speak to your IP about what they would do. I suspect at least 50% will go over to your IVA it may be 100%.
The road is 72months long starting September 2010.

Hi there and welcome to the IVA community,
Firstly i hope you are ok after what sounds like a horrible ordeal. Secondly, and onto your question. I have just won compensation for an injury suffered at work. I have recieved a nice payout and my Insolvency Practitioner is yet to decide what will happen to the money. Here is the thread to my responses.

Thanks everyone for your prompt replies, I am doing well now with no lasting damage. I just called the company who deal with my IVA and they have said that my creditors will get a small amount from the payout but i will be able to keep some of it.

I think you should be able to keep the part that is for pain and suffering so when it's settled make sure it's specified how the settlement is calculated.
