considering a IVA and Bankruptcy

I wondered if I can get some advice I am considering a IVA and Bankruptcy am not sure yet as finances are tight my question is I was discharge from bankruptcy in January 2005 now if I go bankrupt again what be march 09 I know there will be restrictions do they do a attachment of earnings or set a fee to pay per month for so long

Hi Ian and welcome to the forum

There will be further restrictions on you with a second bankruptcy occuring within 5 years of the first one. You should take advice from an insolvency practitioner as to the effect of theis, and whether an IVA is viable. Creditors will be concerned about a second insolvency so soon after the first, but if there are good reasons there is not reason wy you should not consider either an IVA or bankruptcy depending upon your circumstances and actual preference.

Well I just over spent on catoluges and max credit cards most of it is a massive loan and my payments were not good enough thru DMP so I have no choice as everyone has rejected a IVA even your office so have no other choices but like to say thank you for your such quick responses

I am sorry we were unable to help Ian, but to do an IVA or a DMP you have to have some disposable income. I assume that you are now looking at declaring yourself bankrupt?
