Correcting credit file

Hi guys,

Quick query about ensuring default dates are right. Who is responsible for putting on correct date of IVA default? The creditor named in IVA or the company they passed debt on to afterwards?

I complained to original creditor but they refused to uphold complaint as they sold debt on 6 months later, and are advising me to contact the new debt owners.

I was always under impression its the initial company who was named in IVA paperwork.

Very confused as to whether they are taking the p***

You need to speak to the new creditor.

Whichever of the two who actually lodged the default will be resposible for correcting it --- point out that the Ombudsman will be asked to intervene if they do not co-operate.

Ah cheers for that.

The infamous TTI-SPC who are so mysterious they arent on data controller list unless they are known as someone different.

Shop direct confirmed in letter they were aware 8 days after IVA started of it, but dont appear to indicate who advised credit ref agencies of wrong date which is handy.

My shop direct creditor moved to tti-SPC I had emailed them last year to correct the date on my credit files but it still hasn't been done

Write again and threaten them with the Ombudsman.

One instance I had like this I wrote to both. Both replied blaming the other so I complained to the ICO about both. They are both still playing the blame game and the ICOs office are so slow I think the entry will have fallen off before they do anything about it. :cry:

This is one problem with the ICO -- speed (or lack of) ! But, often the threat works (not in this case!).

Have you tried disputing it through the credit agencies? I know the general concensus is they do not want to know but I did have some success with Experian and Noddle (now creditkarma) when I had similar problems. All they do is pass your complaint on to the creditor but the benefit here is they will know for sure who entred the default date and contact them. Worth a try

If you are able to contact the Companies via Social Media that's the quickest way to get disputes resolved these days - they hate other people seeing how bad they are so it tends to motivate them to act more quickly.
