Think this shows that br is not the easy option that some people think it is....

Thanks everyone, I need to go to CAB anyway soon about ANOTHER separate issue, so maybe I can mention this whilst I am there!

My last job owe me money and they will not pay it to me, 3 times they say they have posted a cheque, since January, and I have not received anything. My job before that, I am owed one whole years Agenda for Change Pay Award back pay, I claimed it in writing, as instructed in Jan 2006, NOTHING. I wrote again a few weeks ago, and conveniently, they have no record of me at all on their systems! Hhhmmmmm

I give up! I am tearing my hair out right now [:D]

hi,
i work in benefits for the council,
you should get the class c exemption but this is only applied once and lasts 6 months. after this is changes to 50% liability. but you will be held as the liable party on the property until the repossession order takes place ie 13th march 08. the liability will then become the responsibility of your mortgage lender. however the bankruptcy rule could also apply if you have been made br.
if anyone ever has any housing benefit or ctax benefit questions feel free to ask.

jane send them your bankruptcy order cos they'd usually require proof of this. that might help them with things.
CAB are usually really good so hopefully they'll get it sorted for you.

that's handy Connie, I have just handed my H/B form in today and got a list of 'things needed' eg., ID, proof of tax credits/child ben and bank statements!! Why Bank statements?? I find that quite cheeky!!! AND they want to know my 2 eldest's wage info....I don't know how much they earn to be honest....

we take into account earnings of people in the property who are no longer in full time education as the government say they are expected to contribute towards the property. they have wots called a non dep deduction which is basically a set amount they'd take off any benefit your entitled to and it depends on what there gross wage is as to what its set at. if you don't provide there payslips they'll input the maximum non dep deduction which i think from april 08 is £47.75 per person so its quite high. only applies when there over 18 though.
unless your getting dla care then there will be no non dep deduction.
bank statements are because we take capital into acct. they'll need 2 full months transactions for each account you hold. it also shows up any credits. eg. some people don't declare all there income and we pick it up from the bank statements. you can also see transfers etc to other accounts that are sometimes not declared. if your capital is under 6000 then it won't affect anything benefit wise.

thanks Connie that explains everything. I thought it would be something along those lines. As I only have 1 b/acc and no savings that should be ok. I'll explain to my kids and they should be ok about letting me have their wage slips---I'll just have to promise I don't look!!! lol
I'm not expecting to get much anyhow but every little helps. Thanks again, I've got a feeling you may be quite busy on here with people's questions....

you can have as many bank accts as you like thats not really a problem. its just the total amout of capital in question. if you have in excess of 16k for e.g your claim would automatically be nil regardless of income. unless you were on guaranteed pension credits. (for over 60's). anything under 6000 is not taken into acct. between 6000 and 15999 they work on a capital tariff thing.

Yes take copy of order to the Council. They should then grant this exemption.
With regard to AUDDIS who gave you this info AUDDIS is used for the initial instruction for DD's. if you have cancelled this is then sent from your bank to the originator using ADDACS system which officially cancels it - it sound as though your bank have not cancelled the DD! They cannot keep reapplying the Direct Debit if you cancel it! I would suggest you submit an indemnity claim to your bank, you are entitled to an immediate refund if this money shouldn't have been taken from your bank.

I thought it was strange how they said they could re-instate the D/D! If that was the case it would make the D/D guarantee a waste of the paper it was printed on!
I know if you make payment with a card they can continue to use the card details to obtain payments without your consent.

My bank has cancelled the DD, but I got a letter from them saying because IR are part of this scheme, they can re-start the DD whenever they like in the future because they had the original permission, even though it was 2 years ago! I am changing bank accounts now just for peace of mind, I will have NO direct debits on that new account, I pay everything in cash when I get the bill now through the post office, at least I will know how much money is in my account and no-one can touch it![:D]

I would query that with someone higher at the bank i run the the Direct Debits for my employer and i have never heard of that - once cancelled its cancelled unless you give the company instructions again - who is your bank??
