hello everyone,

I urgently need some advice, I know that you all answered my main questions last time but I was wondering exactly what I do now. I have received the forms from court issued by Northern Rock, I just wondered which part I fill in? I agree with the amount owed but I don't want to put forward a payment amount because I am going to file for BR on 29th June and wont the OR work out any spare money for an income order? if I don't reply will the NR decide how much I have to pay with the CCJ and how long do these payments last? I thought going BR would sort everything. So sorry to ask so many questions I am so confused now. 22 days til court!

Hi Rachel

The bankruptcy order will overturn any payment you make under the CCJ in any case. I suggest that you return the forms to Northern Rock and explain that you are going to petition for bankrupcy shortly and that the Official Receiver will then be able to deal with their claim.

Melanie, Sorry to be a nuisance again, I was just wondering do I complete any of sections on the forms which I am returning or just leave them blank? I agree with the amount owed but I am not offering any payment because I am going BR so none of the sections really apply, also it was Sols acting on behalf of NR do you think I should send it to them or just directly to NR?

I suggest that you return the forms with a covering letter saying that they are not completed as you are not disputing the debt, but will shortly be declaring yourself bankrupt.

I just wanted to say thankyou for your help, this website is amazing, the advice given and also the support everyone gives to each other is brilliant. Also to anyone who is going through a stressful time at the moment, it will get better, my IVA was rejected and so I'm going to go BR and although stressful now I'm sure we have made the right decision. However low anyone feels there is always someone there for you and this website proves it.

rachel i wish you luck with your impending BR, i done it on the 25th April, and the relief from it all is fantastic, no more calls, no letters, i am back to being a mum again, not spending all my time on the computer looking for answers, ok its not an easy road to take and not one that you enter into lightly, but like you i had exhausted all my options and this was the only way to go.

Thankyou Kerrie, I know what you mean about being a mum again, thats been the hardest part, no more phone calls - heaven! I thought I was passed all that but of course because its taken so long to get to court I have had the phone calls and the sols letters starting now as well as court papers, even though they know I can't get to court any earlier! I suppose they deal with some people who aren't very honest but never mind.
Thanks again and I will let you know how it goes with the OR (nervous about that too!)

its ok rachel you could have just edited the post, i am use to it being spelt all different ways, good luck with the BR, i am sure once the judge realises you are going BR he will adjourn the CCJ either way it will be included in your BR, i had my letter today off the OR asking if i was interested in my BI for the house, and have 21 days to get 2 valuations so he can work out what it will be, only problem is when you tell the estate agents what it is for they won't come out until i have paid them £150 so i will have to resort to a little white lie and pretend i am going for a quick sale, so hopefully they will come and give me a valuation, not holding out any hopes of raising the BI tho, the kids are actually looking forward to moving, except one of them,but all in all we are spending time again as a family, and they are enjoying the fun again, as your will.

Thanks Kerri,sorry for late reply I'm still getting used to using the site - I've never used a forum before (I know how sad!) We don't have alot of equity in our house but more than we could afford but luckily a family member has offered to help out so hopefully things should be ok.

good for you rachel, glad you have help in that department, we have had 3 houses sold this week in the avenue for a lot more than i thought or hoped we would get valued on and with mine being a semi with a drive way they will value it higher so there will be about 30k equity and the lower end of the scale so there is no way we could even raise half of that, and i will not let mum and dad bail me on this one its too much, we are going for a fresh start, apart from the fact my eldest wants his own room so we are looking for a 4 bed hopefully, he is looking forward to it but my 8 yr old doesn't want to know he will not go he said.
you sound more positive, the date will soon be here and it will be all over ready for you to start again.
