Court Letter...out the blue!

Just as you start to stop getting those awful letters and phone calls, then we get a court letter out of the blue.
We got it yesterday, to do with CL Finance/GE Capital, saying as we hadn't paid them we had to do through the courts etc!!!!
I just phoned my IP, and she was as confused as me, as she said they voted FOR at the meeting, and have provided her with figures etc!
She reckons they have passed it on to a solicitor and not bothered to inform them of the IVA...just a minor point to miss out!!!
I tell you though, I spent last night worrying that maybe they hadn't been included in the IVA, or something was wrong...aarrrrgh!
Also Welcome Finance have suddenly woken up and have been leaving messages on our answer phone - my IP told me to ignore them (which I gladly will!).

Hi Kal,

6 months after my hubby's IVA started, LLoyds TSB took him to court. This was despite them voting YES. We( me actually) sent a copy of the agreed vote to the courts with a strongly worded letter and received an apology from the court. Our IP told us that a lot of companies don't tell solicitors etc that they have agreed with the the IVA.

Ahhh Welcome finance, bless 'em. with a.p.r of only 56% [;)].
When these companies were the only ones willing to finance us, we realised it was time to look into an IVA. I have no doubt some people have been quite happy with such loans, but once again, talk about kick you when you're down.

We had a letter from Eversheds yesterday telling us that Barclaycard sold on my debt to Max Recovery and will be administered by Eversheds LLP Solicitors. It goes on to mention bankruptcy - I am in an IVA!

It does mention that they will deal directly with our case manager and we probably won't hear from them again, but why send this letter out now? And why, if they sold it on on the 10th April, did I get a phone call from Mercers on the 21st April (the day my IVA was agreed) demanding money?

I had a phone call two days ago from Barclaycard telling me i was 2 months in arrears with my payment. Told then actually I wan't in arrears at all as I was now in IVA. The girl looked at my notes, and said oh yes here it is, IVA accepted 14th March, but it hasn't been agreed!!!???!!! She then said I was still in arrears tho as no money received from IVA!!!??? I explained how IVA works and that she should speak to relevant dept in her company who deal with IVAs. She said she would note my account which would stop any more calls for 2 weeks till it got sorted!! I told her to refer to my IP in future. She said again that IVA not agreed (Barclaycard voted yes by the way!) and then quoted me my IP's phone number in case they had to ring them!! Left hand and right hand springs to mind!!

Got a letter today from CL Finance telling me I had missed my last payment and my concessionary rate of payment would be reverting back to normal. This letter was dated 28th April, which was a week after my IVA was approved, and they did't bother to vote!

I rang them and pointed out that I wouldn't be making a payment as I was in an IVA. The girl did have some difficulty understanding this and kept talking about me going for an IVA - no, I'm IN one! She then asked me for work and mobile number, which I refused. She also asked if she could ask where I worked - I told her she could ask, but I wouldn't be telling her!

I know they have been sent a copy of the Chairmans Report, so why can't that department filter down the information to the call centres.

I don't mind the letters/phone calls now as I know there is nothing they can do, but I do wish they would get their act together.

I do find that it seems to be the same culprits each time - GE Capital used to always send us letters when we were in a DMP, saying we hadn't paid them - when we had.
Theye were always the ones to hassle us with phone calls, and then they don't bother to vote either.
Funny how yesterday we had a letter from them asking us if we wanted a loan....almost worth applying for a laugh!
I have also had about 6 or 7 phone calls from littlewoods since we set up the IVA - each time asking when I expect to make payment...they are very nice, and always apologetic about phoning me when I tell them about the IVA...until the next call i get, and then it all starts again.

Don't any of these people ever bother to make entries on their computers? I had a phone call asking if I wanted a loan, I just said I wasn't interested.

I thought all the phone calls etc had stopped as I hadn't had any for over a week, but obviously I was wrong!

Oh well, I think I'll make a recorded message and just play it back to them when they ring again!

We've been quite lucky so far as at the same time as starting IVA, we went back to BT, who changed our phone number.

The only ones with our phone number now - apart from family and friends - are our new bank, Abbey, and our IP.

I'd recommend that to anyone.

We haven't really had any threatening letters - yet either. Even when we missed the last loan payment before the IVA went through Barclays didn't even send a letter.

I'm sure that will all change though.

Gosh Lola, you were lucky there. I got hounded by Barclays about a week after I missed a payment

We are with BT as well and have broadband talk which has a new phone number. I still kept checking on the old line (you keep that one as wel), and loads of people were phoning but if you don't hear the phone ring, then you can't answer it can you?

Letters I am very good at dealing with and give back as good as I get if they start threatening me.
