Since IVA acceptance I've been sorting out old paperwork. I had an isa account last year, only £1.01 in it, so I thought I'd just close in down. Phoned Alliance and leciseter, they can't close the account because there's a court order on it! Now I'm really confused, they weren't one of my creditors, and the account is savings only. I couldn't even withdraw the £1. Does this mean every account I have savings, whatever have court orders on them. I also had old abbey account agin only £10 in it but I was able to withdraw that. Not sure whats going on, a bit worried.

Did you have any debts with Alliance & Leicester? If so, they are probably exercising set-off against your ISA account, but I am not sure that this is legal.

I have a secured loan with them, never missed a payement. It isn't part if my IVA as it's secured. To close the account they told me I'd have to go to court, obviously I'm not going to bother for the sake of £1.01 plus pennies interest, but how can they apply for a court order without me knowing. They may know of IVA as they are included in my proposal as a secured debt but I don't see how this court order came about. Is it worth contacting experian to see if any credit is listed, incase someone stole my ID to get a credit card in my name pre IVA.

It's not a bad idea if you feel exposed on this point.

What happens if I just ignore this. Will the court order stay indefinately or be removed after completion of my IVA or secured loan?

Have contacted alliance and leicester again, they can't give me any information, only that they have had a letter from the court blocking the account. They can't tell me which court to contact or anything. As I have had no letter from any court who do I contact? Would the court administering my IVA know about this? Could this be related to tax, isa account being tax exempt? This is just great...I have a court order against my account that no one knows anything about... I thought things were running too smoothly!

It is extremely unlikely that any Court will have written to your ISA provider. Ask A&L to explain in more detail or send you a copy of the letter.
