If, when you receive the claim, you complete the admission form, not the defence form and you fill the form in fully so that it shows you can afford £100.00 a week and send it back to the court (not the creditor as it says on the form) and your creditor agrees with your offer of payment then you will get an admission judgment telling you when you need to make your first payment by. If the creditor refuses then a determination will be made by a court officer and you won't go to court. If your form shows you can only pay £100.00 per month then that is what the court will order whether your creditor likes it or not. If your form shows you can pay more than £100.00 then the court will order you pay more. Either you or the creditor can request a redetermination and the matter will then go to court
for the Judge to decide. You get a five minute hearing so learn to talk fast!!!

You are best returning the admission form to the court and them sending a copy to the creditors. You would be amazed at the number of admission forms sent directly to creditors that go missing in the post and the first you know is when you receive a default judgment for not replying to the claim.

If it does go to court then it should be listed within three to five weeks upon your or the creditors request for redetermination. Because they are short hearings they get pushed into the lists so you won't have to wait months.
