We have just been transferred from PJG to credit fix and after five and half years of a six year plan we have requested a full and final settlement due to my wife's I'll health. All documentation has been sent but it seems all the onus is on us to chase up credit fix and tonight we have spoken with them and basically because we haven't signed and returned their new terms and conditions they have said that the creditors have declined our proposal (we were not aware of our creditors meeting if it had even taken place) suggested we sign their terms and conditions and then we wait for their mass variation meeting whenever that may be. How can they do this? Should we just sign it? Thank you
Ask for minutes of the creditors meeting to be sent within 24 hours, email Susan Wriglesworth and Pearse Flynn (Emails are firstname.lastname@creditfixme.co.uk so nice and easy)
Explain to them that if they can't supply a very valid reason why they have kicked your F&F back that you'll go to the IP service with a complaint.
While that is stewing, go find your local CAB, let them know whats going on, they can usually supply a load of help for free usually.
If they tell you they can't send a copy of the minutes, return fire with a Freedom of Information request, request all data they have on you (you'll use this when putting the IP service complaint together and its eats into their time to deal with other stuff.
They internal complaints procedure is non existant, so I just go for the top (Pearse is the CEO)
This amounts to coercion to sign the new terms. I imagine the creditors would lose far more with the fee hike than they would agreeing to your settlement.

Thank you Doritos this is really helpful but I am not convinced they have even submitted our final paperwork to a creditors meeting as it was only sent one week ago. An email from Stephanie at credit fix I read tonight says they would not submit our proposal because it would be declined as we had not signed their terms and conditions. I am due to speak to this Stephanie tomorrow however I just wanted to know where we stood. Thank you
Don't speak.. its past that, or if you do record the call if possible (You'll need to tell them that you are recording the call as soon as possible for it to be admissable as evidence if it comes to it)
If possible keep all conversations on email as thats trackable and can't be modified / removes any he said / she said as its all there in black and white.
I doubt that a creditor's meeting has happened, it may have been called, but it hasn't happened, they never happen that fast (Asking for the minutes will flush that out).
I'm checking the whole coercion side of things with my legal team, but I've already told creditfix to jog on basically.
I do hope this is a misunderstanding, just as Creditfix seemed to be getting some good feedback....bullying/blackmail? not impressed! perhaps Greg can pick this up????

The IP is supposed to be administering the IVA professionally. They are not the enemy, it's supposed to be a cooperative joint effort with them helping you.
I would really like to hear what Greg's opinion on this is.

Thank you Greg we have had a supportive lengthy discussion with Gemma at Creditfix and what a difference a day makes. Our full and final settlement proposal will be put forward without the need to sign new terms and conditions with a creditors meeting set for 20th Feb. Fingers crossed and our thanks to Gemma for listening and her time today.
A great outcome but rather concerning that Creditfix's original comment was that the F&F had been rejected by your creditors - sounds like an outright lie then so what on earth is going on?? Good luck.
