Good evening all hope everyones ok x
does anyone know what a creditor can do whilst youre waiting for a decision on an iva acceptance-only in preparation stage at mo-i do have an excellent ip.
what i mean is apart from calls/letters is there any action they can take whilst youre waiting?
sorry to ask but it is worrying me a lot thanx x

Hi there

Just to have an IVA in prep doesn't have any legal standing and creditors can theoretically do anything they could do at any other time.

If anything serious is threatened ie Court action the IP can get an Interim Order to stop it.

hi there FD

Creditors will hassle you by letter and phone as you know, and if its anything you are really worried about let your IP know and they can reassure you and offer help.

I promise you that when you are in your iva this whole horrible period will fade from your memory and you will feel settled and happy again.

Hi

I don't think the Interim Order is used much these days because in most ppls experience the creditors do just moan and groan and not a lot else.

However it's nice to know it is there if you need it.

Creditors will continue with any collection action that they are entitled to under the terms of the contact with you or within the law. You will probably find that they threaten you with legal action, but it is rare that anyone will commence this against you unless you have a property where they may feel that charging order action would bring them some advantage.

Well you are most definately not a criminal! So put those thoughts right out of your mind to be replaced with "I am a sensible person, and realise that I have a problem, and I have sought expert advice to help me sort it out".

Recite that 100 times before bedtime and in the morning all will seem fine!!!

Hi Hun

Glad youre getting sorted out.

Please dont worry about the calls and letters, I know they are scary but: Calls come from call centres the staff there are told to reach a target, say £200 pounds and they just phone a list of people and try to do just that. They arent interested in anything but that, its money, money, money, Most dont even know what an IVA is, or BR for that matter, they are trained to extract money, its almost a yeah but, not but, money but money but, do you get the picture?

The letters are generated by computers, that dont speak much English apart from pay or else, all of the scary words are in bold.

They shout so loud and so often because they cant cut you off, throw you out, or throw you anywhere else for that matter.

My house looked like an explosion in a nasty letter factory. Try not to take the calls personally, these people are just doing a job of work.

Just inform them that you are going to be proposing an IVA and hang up, its really not worth entering into a conversation with them, dont let anyone upset you.

Believe me hun, I had my moments when I couldnt even see through the tears, or couldnt keep anything down with the stress. Its really hard and I know that, you even keep reading posts over and over again to try to convince yourself youre going to get through it. You feel like youre never going to be happy or be able to smile.

I felt really guilty and embrassed of my situation and an overwhelming shame.

Believe me that does pass and I feel proud that I sorted things out and am in the process of paying back what I can.

You must not feel like a criminal at all, you are facing up to things and sorting it all out - be proud of that.

i can't put things as lovely as Lily always does, but am thinking of you all the same and wishing you well[:)]
