Creditor breached IVA

Hi all...haven't been on here for a while. Hope everyone had a good xmas a wicked new year!!

anyway quick scenario...
I have been in an IVA for 3 years and recently have been receiving phone calls from a company called Credit Solutions Ltd (CSL) who are a debt recovery company. Apparently, one of my creditors who have been included in the IVA (The Student Loans Company) have given my debt to this company and are claiming that they have not been paid. CSL have got to be the rudest people ever to grace this good earth! After receiving about 10 automated voice messages not saying much, I finally called them to be verbally abused by numerous people. I tried to tell them that my 3 student loans have been included in my IVA but they kept saying that student loans are a government grant and cannot be included in an IVA.
These people threatened me over the phone and basically said I had no idea what I was talking about.
They have since sent their claims to me in writing which I have passed onto DFD but they are still calling and generally harrassing me.

I was under the impression that an IVA protected you from being harrassed by your creditors and my question is if the Student Loans company have not been getting any money then where is it and how can they just refer the debt to a debt recovery company without letting me know.

My IVA company DFD have said that all I need to do is forward the letters on to them and they will deal with them.

I have done this but am still being telephoned everyday of the week and left messages by CSL.

What do I do now?

You need to keep pressing DFD to sort this matter out for you. The collection company are still bound by the terms of the IVA and they can not touch you.

Hi,

What a nightmare!

Does it say on your chairmans report that the Student Loans have been included in your IVA? If so, I would be tempted to send a copy to this company to show them.

Companies can transfer the debts across to another company, I have always found that the company that buys the debt will get in touch and tell you.

Pass everything on to DFD and ask if they can deal with this asap as you are suffering from stress because of it.

I would tell this company as well that they are harrassing you and you will report them.

If possible, I'd change my phone number if I were you so they can't get hold of you.

I would contact CSL again to update your phone details and give them a duff/old one to stop the calls in the meantime.

They do tend to employ people who know very very little about insolvency law. my mortgage lender recently told me if we surrendered our house as planned at the end of the month it would affect our credit rating, i was BR in October it doesnt get any worse which I had told her several times during our conversion, but she was reading from a script no doubt.

take care hope the calls stop and DFD get it sorted.

Thanks for all your advice.

I was thinking of changing my phone number but I've had the same mobile phone number for 13 years and when I was going through all the trouble with setting up the IVA 3 years ago, I never had to change my number so I'll be damned if I'm gonna let some rude ignorant people make me do it!

I'll get onto to DFD on Monday and take it from there.

Hi lollie, no i dont mean change your number, what I mean is call them to say you have and give them a ficticious number (not yours) and they will update their records and it will lose your own number on the system. Where I work we update people telephone contacts and it deletes the previous one, it stores addresses but not contact numbers. Its worth a try.

I did this with a few of my creditors prior to setting up IVA and never heard from them again by phone anyhow.
