One creditor has actually written to me and told me that although they are aware I am in an IVA, they still expect me to pay the whole lot anyway. Can you believe that? I still have the letter.

I am minded to ignore it unless there is a chance I can take the matter to court and have them struck out of the deal. Any views?

Find a pro bono solicitor (or a no win no fee) you will save a fortune - I think

You wouldn't able to remove them from the IVA dickieb. The only thing you could would be to take them to court for harrassment.

Personally, I would just ignore all letters like this - they are totally worthless.

Managing Director UK Cards.

I am in the process of collating all your comments on Barclays and Mercer's so keep them coming and I will give them to him - i might be seeing him next week at the Consumer Finance Forum.

Another one for Davids list
Barclays finance have sent 3 x default notices in 2 weeks informing me of £ 22 charges each time ,this after numerous phone calls where i informed them i was in iva also recieved a letter from egg today asking to settle my balance in full although acknowledging acceptance of iva, was that the same creditor dickieb

They are stupid aren't they?

The charges mean nothing, so don't worry about those. Can't believe that Egg would acknowledge the IVA - and then ask for payment!

we had that with egg as well. we had 3 credit cards and a loan and had a letter come about each one noting iva was approved but they still wanted the outstanding balancing paying now

so do i sometimes. barclaycard are driving us nuts at the moment we had our iva approved 2 weeks ago and ever since they have been ringing us about 8 times a day asking for payments. it dont matter how many times we tell them about the iva they wont stop ringing

I'm afraid I would lose it with them now!

I think you will have to start threatening them with court action over harrassment.

Don't forget to get the name of the person you are talking to.

we have lost it with them told them not to call anymore and that we would start harrasment proceedings but still they ring even on sundays and on bank holiday monday. they start ringing at 8.30 in the morning up to about 8.30 at night.

I think that I would write a very strongly worded letter to Barclays Head Office to tell them to back off otherwise you will be getting in touch with the courts to report the harrassment.

In spite of the recent pleasant call from Barclays (don't know from which Branch) we have had nine calls from them today the last two most unpleasant and threatening just about everything - my husband told them about the IVA - he was told "we are not interested you pay now or we will sue for full recovery and costs". We are not concerned because of the accepted IVA but their attitude could send one into a real state of anxiety - they do not seem to care and are certainly either ignorant of IVAs or they consider themselves to be above the law. J
