They are just call centre morons J and are sticking to their script.

Perhaps the nasty calls are because they haven't made enough money today![:D]

yet more calls from barclaycard today told them yet again about the iva and this time they said thats not our problem you need to contact the people who are dealing with it and the calls will continue. they are doing my head in

Don't worry about them - my husband's IVA was accepted and we have had six calls already this morning! As Jan said yesterday - they follow a script and they want their commission! J

tlr - I know they should not be phoning you, but any chance you could change your number and go ex directory? They should leave you alone then.

I would have a word with your IP as well and tell them that the calls are still happening.

Could these people be sued for harrassment? Imagine having to payback 50% of the windfall damages [:D]

If anybody in an iva managed to take a creditor to court for harrassment and won then surely this money would be classed as a windfall and be returned to creditors in an iva. Therefore would they not be getting thier own money back as a windfall. As another thought if you left the case until after the iva was concluded then the money may be able to be kept.

ivas4us - I don't believe that damages awarded in a court case would be classed as a windfall as it is a payment for stress and a health related matter - I would be inclined to view it that way.

Thats a good point. But in reality the creditors know that nobody is going to sue for harrasment if they are in an IVA as it would be unaffordable.

Agreed but it is the police that should be taking the action!!

That puts a different slant on things. It might be worth contacting police if the calls are aggressive as some posters have experienced. I must admit not had anything now for close on 2 weeks.
