Hi all
Just had a call from barclays finance regarding payment for arrears,the guy informed me the call would be recorded, no problem with that, i told them i was in an iva but he reckons they have not had any correspondence from my ip,he then went on to offer me a repayment plan if i start today, very nice of him,after telling him they were all legally bound by the iva and they had declined to vote he asked me to get my ip to contact them and hung up,after avoiding this firms calls for 3 weeks decided today to get it over with,THANKS to the advice given on this forum it was not as daunting as i thought it would be as i had the answers ready for them , bring on the rest.[:D]

I know people keep saying left hand doesn't know what right hand is doing but in the case of barclays we have top ask ourselves are the hands belonging to the same body even!!!!

Seems strange that you recieve a letter confirming iva and that they will now deal directly with ip . then you get constant calls from the call centres cant wait until tommorrows calls, maybe its time to start asking for names of these people .

It does sometimes take a while for the info to filter down unfortunately.

Mind you, once you have told them you are in an IVA they should just accept what you have said.

I thought that once the IVA was in place that is would be classed as harassment for them to keep calling?

It is classed as harrassment as they should cease calling as soon as your IVA is approved.

I was fortunately that I had one, from Mercers, on the date of approval and haven't had one since.

However, should they try to call, they would get their answer!

SECTION 40 OF THE ADMINISTRATION OF JUSTICE ACT

“S40 Punishment for unlawful harassment of debtors.
A person commits an offence if, with the object of coercing another person to pay money claimed from the other as a debt due under a contract he-
harasses the other with demands for payment which, in respect of their frequency, or the manner or occasion of making any such demand, or of any threat or publicity by which any demand is accompanied, are calculated to subject him or members of his family or household to alarm, distress or humiliation;
falsely represents, in relation to the money claimed, that criminal proceedings lie for failure to pay it;
falsely represents himself to be authorised in some official capacity to claim or enforce payment; or
utters a document falsely represented by him to have some official character, or purporting to have some official character which he know it has not.
A person may be guilty of an offence by virtue of sub-section (1) (a) above if he concerts with others in the taking of such actions as is described in that paragraph, notwithstanding that his own course of conduct does not by itself amount to harassment.”

Trouble is these companies realise that if you have no money to pay them then the chances of you affording a court case for harrassment is virtualy nill.

A lot of these call centres are totally seperate entities to the companies you owe money to and it can take a while for the info to flow down to them about IVA's etc.

Get a loud whistle and give them a peep if they get out of hand!!
Discharged today the 8th feb 2012. View is much brighter now.

the link that tele2002 has posted above says that under the consumer credit act then the original lender would be responsible for the actions of any third parties. I am sure that David's case would certainly be harrassment under the act.

Proving harassment is never going to be easy or perhaps even worthwhile doing. You could try to contact your local MP about it. I prefer my whistle treatment of annoying calls.
