Bless Robinson Way...NOT!

Another very threatening & intimidating phone call at 8.30am this morning, demanding payment. I was then advised that the call was being recorded, blah, blah...

Apparently (according to the idiot on the phone) they are going to vote no to the IVA proposal and make sure I go bankrupt....

So, I asked the caller if he knew about Section 40, The Administration of Justice Act 1970. I was met with a blank "Wha..?" So I then quoted it word for word as posted by Reviva UK (Thanks Mate!). I also asked him if, as the call was definitely being recorded, he could make sure his supervisors were aware that if the offensive calls continued, I'd be exploring it further. I also told him that he needed to check his records, as, if he did he'd find I have a creditors meeting for my IVA on 3rd March at 10am.....[}:)][:D]

I wouldn't mind if they were polite, as they are only trying to do a job, but the ruder they are, the more I'll mess with their heads. It's really odd, because in the past, Robinson Way have been very reasonable to deal with. Now 2 threatening phone calls in 4 days...

just because you have some debt doesn't mean that you are a sinner and should be spoken down to!!

Interesting that if they are going to make sure you go bankrupt then why are they wasting their money calling you? perhaps they should just get on with it and petition for your bankruptcy, however this costs money so unless the creditor is HM revenue & customs, Amex, Jewsons or DFD they probably won't make you B.

Apparently only 20% of Bankruptcies are creditor petitions - leaving 8 0ut of 10 arranged by the debtor. Interesting

What a silly call from someone who is actually only owed slightly over £500! Well done for sticking to your guns Robbiecat, and to Reviva for producing the information on the legal position. This should be placed in a prominent place on the forum so that others can use it when faced with the same diffifulties.

To be fair to the pillock at Robinson Way, they got me before I'd had my morning dose of caffine and the furry menagerie had been fed breakfast, so they didn't really have much hope of me being civil, LOL![:D]

No 3 on Reviva's post is a deffo stop for creditor calls. If they are unable to confirm who they are speaking including name / address + one personal item they can't continue the call.......Data Protection Act being turned on its head.

FYI - re harrasment and the 1970 act...... what is deemed acceptable is a maximum of 5 attempts to each number held for a creditor in any one day. Once the creditor has spoken to a confirmed debtor in any one day all calls should stop for that day.

They didnt at customer services after i quoted the telecommunications act. They never spoke to me again. lol

They were probably speechless! [:D]

I think it was Andy that posted a letter that you can use for creditors, something about the consumer credit act as I remember. I used it when someone came knowcking on the door once ... they went off down the drive scratching their head in a somewhat bewildered way, reading the letter!

To the other extreme secure homes actually rang me and said I could keep my account if I wanted, even though two of my debts were with them. I thought that was nice.

When I knew I was in difficulty I rang all my creditors before they had a chance to ring me, This seemed to work. When I did get phone calls I was very polite and kept them up to date they seemed to respect this. Letters I recieved I passed on to my IP who promptly delt with them. Some of the creditors when I told them I was about to start a IVA they put holds on calls for up to 2 weeks
