Hi my IVA was approved on 03/10/08 and my name still hasnt appeared on the insolvency register. Also two of my creditors Barclaycard and Marks and Spencer are still chasing me for payments. Today ive put everything in a letter and sent it along with my two credit card statements to my IVA company. Lets hope they can resolve this for me and also reverse the charges that these companies have added since my IVA was approved.

Hi

It has not been unknown for there to be spelling mistakes on the Insolvency Register. Try searching using the first few letters of your surname, you may find the entry.

With regards to Barclaycard and Marks & Spencer, it does sometimes take a little while for the fact that your IVA has been approved to filter down to the collection centres. You have done the right thing by forwarding the mail on to your IVA company. They will be able to ensure that the right people are notified of your IVA.

Your creditors are not allowed to charge any interest or default charges to your accounts once the IVA has been approved and can only claim for the balance outstanding at the day of the creditors meeting.

Hi Elizabeth i have tried searching my name differently on the insolvency register incase of mis spelling but its definately not there!!! Hopefully should recieve some news reagrding this this week.

You're doing the right thing by sending off the statement to your IP. Let them deal with it.

Don't worry about the charges, as Elizabeth says, they can't claim those from you.

Hi Kool

If you do not find it there this week give your IP a ring and check that they have registered it. It will not make a difference to your IVA, if it has been approved then nothing can change that. It is however one of your IPs duties to ensure that it is registered.

It is important that you draw this to your IP's attention, as it is their responsibility to ensure that your IVA is correctly registered - we do this as a matter of course, because as Elizabeth has mentioned there are occasional errors within the Insolvency Service.

15 months on Barclay Card have still not defaulted my credit record - they are showing it as overdue !!!! Even though they have been told several times - the fact it is for £373 only I cannot be bothered at this time to waste any more of my time - however had it been for more then I would be hopping mad !
