Creditors Harrassing!!

Our IVA was agreed last Monday 5th March and today especially, I have had Mercers on the phone. Apparently my husbands Barclaycard debt has been passed to them. They won't accept that we are in an IVA. I have had threatening letters from Next and this evening I have just had someone from Lloyds TSB on the phone. I could not get rid of him. I explained that we were in an IVA, gave him the court number etc but he was not interested, all he kept saying was "but we have not received an income and expenditure form" and it did not matter what I said he kept saying the same thing. I told him to contact my IP but he would not have any of it and said that they would keep ringing me and why if my IVA was agreed last week had they not had any money? I explained to him that he should know how an IVA worked and in the end I said I would report him for harrassment and put the phone down. Is this ever going to stop and why won't they accept the outcome of the IVA. Please help I am at the end of my tether yet again.

I,m afraid that its all perfectly normal !!!
These are huge financial institutions that ou are dealing with and quite often communications between depts are slow.
Rest assured,and be in no doubt,you are protected now from any further action from creditors.If they do not recognise an IVA its because they probably don,t even know what it is !!!.They have to abide by it..........full stop.
All should calm down as the days go on and if they do ring then just have a standard "speach"and put the phone down.
If you get persistant offenders then speak to your IP and pass on the communications.
Just one word of caution,a forum member has had Next instruct bailiffs some six months after the IVA,So if you get communications pass them onto your IP,do not ignore them and if they continue ensure that your IP is actively doing something about it.
You can rest assured that you are on your way to a much brighter future.
Good luck and start counting down from 60

Hi Neverending,

Thanks for replying to my questions, perhaps I will become as knowledgeable as you one day!! yes, I am very well aware of Next, I have written to them twice and will ring them to contact my IP. I do not want the bailiffs coming. Since my earlier post, I have had Mercers on the phone yet again for my husband and G E Money for me. In the post today I had two default notices from companies who voted yes for my IVA. I don't think communication exists in these institutions. I have never had so many creditors ring in one night. I have been trying to watch Masterchef as well!

As Neverending says, refer all these matters to your IP as it is their job to manage the creditors from the date of your creditors meeting.

I think debt collection agencies work primarily on the basis that people will give them money to shut them up and any legal framework is strictly advisory.

As others have amply stated above you have nothing to fear from them. You are nowhere near getting bailiffed unless you already have a CCJ.

Save yourself a lot of bother by simply not answering the phone to them.
