15% is quite normal, it probably just seems a lot if your contributions are high.

If your wife pulls out of the IVA, how will she afford to service her debt repayments? Is she jointly liable for the Northern Rock debt?

Hi Jan,

No all the debts are in our own names. My wife had debt problems when I met her, but i paid them off and then started taking out credit for her. So most of the debt is in my name.

I'm sorry for moaning. It looks like she is going to pull out and then I will have to phone my IP tomorrow and see what my options are. Thanks for all the advice everybody.

I am so sorry youre in this position, you must feel youre being pulled all ways from the middle.

I hate to say this but your wife is either with you in this or she isnt. Having an ultimatum about the car isnt helping at all. Youre doing your very best, these are the creditors terms and its not really your fault. Would she really be happy driving around in a 10K car while you are on your knees trying to do your best?

We all make mistakes mate, noone is immune from that. You need to sit down and make a decision and what will be, will be.

Good luck now and please keep posting, youre amongst friends here.

Does your wife own the car or you?

Its my wife's car. I don't drive. We would lose it in Bankruptcy anyway, so I suppose we are lucky to be given the option to buy a replacement.

Yes Mrs s, you hit the nail on the head. The trustee in BR would allow funds for a replacement car also but not as much. You could look into getting a motability car, the only reason I didnt have these is my mileage was too high.

Do I take it that you can't claim mobility allowance for your child?

Im sorry but i am at a bit of a loss here.
I find it really harsh that your wife would rather keep the car and see you struggling and worrying the way you quite obviously are.

Im sure she has benefitted from your debts and therefore should be willing to do what it takes to help get you out of this hole.

dont really get this having to sell the car thing at all for a start off who would buy it off you in this financialy difficult climate anyhow, and if there was interest you can bet your bottom dollar you wouldn't get anywhere near what the value should be.
surely nr must be asking for a percentage of the sale value ?
if that isn't the case nr are being unfair

I agree with Mrs Skint that it seems very harsh for your wife to see you struggle so she can keep her car.

I really hope you can sort this out, but please don't agree to anything that you aren't comfortable with x

Sorry I just haven't been online for a day or two!!

My wife is starting to see a bit of sense. She had a major panic attack and cried for most of Monday night. I think most of what she said is just her being scared. We now have sent in a doctor's letter saying why we need our particular car for our daughter. We have changed the car 3 times in the past year and have finally found a car that doesn't affect our daughter's breathing. In previous cars, her breathing was restricted by the position of the car seat. The new isofix seats do not affect her this way, but they only appear to be in newer cars.

NR have said we can have £5,000 towards a new car. Unfortunately, that means the car will already be 4 years old and after a 7 year IVA, it will be 11 years old. We won't be able to afford a new car or even meet the maintenance costs associated with an older car. The problem is we need the car for emergencies associated with our daughters condition.

Our hands are tied and hopefully the creditors give us a bit of leeway with the car. With an 84 month IVA, they are already getting a very high return and as fuzzy_dunlop said, who is even going to buy our car? I could sell it for £5001 and pass on the £1 to the creditors....
