Creditors Meeting

Well my creditors meeting was at 12 today and as yet im still none thw wiser...I called my IP at 1.30 and she informed me that shed only had one vote from MBNA who surprise suprise had rejected outright, neither LLoyds, Lombard or Northern Rock had voted although Lombard had requested a faxed copy of the proposal which she sent over...she was also going to phone Lombard to see if they were voting, she is confident that they will and if they vote yes as in the previous meeting then MBNA will be outvoted. Can they do this because obviously my meeting time has passed? If they do not vote does that mean the IVA will be rejected?

Hi Claire

Sorry this has happened, its not that unusual though. What should happen is your IP will arrange another meeting and badger the non voters into voting. It would all make more sense if it was no vote=acceptance but its not the case unfortunatley.
I hope that you have better luck next time and I understand the feelings of despair you must be feeling right now.

Your IP simply needs to adjourn the proceedings for 14 days, and then chase up the other creditors who have not voted. I am sure that this has already been done, but you should check.

Would have been better had your IP chased Lombard prior to the meeting time.Considering that they voted yes at the previous meeting it was probably just apathy stopping them from voting again this time.
Hopefully its been adjourned again,so next time chase your IP on the morning of the next meeting.
On my variation meeting recently none of my wifes creditors had voted and this was going to put a "spanner in the works".Luckily I had phoned mt IP[assistant]in the morning and found this out,and to say that I was unhappy would be an understatement.Low and behold my IP chased them and one voted.Maybe i was lucky or maybe its because i had "pushed" my IP into action.
This is a major part of your life at the moment so,if you have to ,be a wasp in your IPs ear.You have gone through enough uncertainty.

It is unfortunate but not unusual for creditors not to vote until they are pressured into doing so by the IP. If Lombard voted yes before, then I am sure that they will do so again. As Melanie says, have a word with your IP. If Lombard did not vote in time, then the meeting can be adjourned which should give Lombard ample time to vote
