.............Creditors Meeting two weeks ago!!

On Thursday 6th September was our creditors meeting - It has been adjourned and our IP is working really hard to get them through.

Mine has been approved but Hubby is 3% short and I have been told that mine cannot be approved without Hubby's.!.

Our IP is trying to make contact with Arrow Global whom MBNA sold a debt onto but they deny knowing who Hubby is despite us passing on a letter to our IP's - IP rang the solicitor acting for Arrow who refused to vote and refused to pass on Arrow's phone number - What do we do???? The stress is really taking its toll and I have been told that it can only be adjourned for two weeks otherwise will have to resubmit a new IVA proposal - The stress is driving me nuts!! Anybody got any idea's or hints or tips or anything?? [V]

Is it worth your hunny rnging them about the debt then taking the name of the person he speaks to to pass on t his ip to contact

I would send them a registered letter requesting a copy of your Consumer Credit Agreement (CCA) - they have 12 days to respond. the reply from them and the CCA should be enough for your IP.

Hi All

Thanks for your very quick responses - The problem is we don't have 12 days for them to respond the two adjournment is up this Thursday.....But from the other threads that you have posted for me looks like its a lost cause anyway because they don't appear to vote in favour of settlement figures let alone IVA's....
The IP has contacted them by phone but they are denying all knowledge of hubby!!!and can't find him on their system..........

If they do not respond within 12 days they can not impose the debt without a court order, the judge will be VERY interested in you trying to contact them and them not responding. If they do not respond with 42 days (depending on the date of the CCA) they can no longer chase the debt. So, all said, the letter is worth considering.

I have dealt with Arrow infrequently in the past, but they are generally supportive as they will have purchased the MBNA debt for probably less than 10%. Aren't there any other debts that your IP can chase instead?

Thanks for the reply Melanie - IP doesn't want to chase other debt agency that MBNA sold the other debt to because they will refuse outright, although he has said that an option maybe to pay off one of the debts (Well ask our daughter to do it for us) to bring in the figure below 3% required which hubby worked out at approx £1,500 if his total debts were C£60K. But to be honest we don't know what modifications have been asked for yet but those that have voted and the IP had to work hard to get mine through by persuading creditors to vote/change their vote, I just feel that all this delay from April has not helped the situation and that's why its all going to fail and we will be left to pick up the pieces....Sorry to moan but I am feeling really down about all this now its a long time from April.....:(

OK - well there is nothing to stop a third party paying off some of one of your debts - and I have told you all along you are in safe hands with your particular choice of IP, so leave it to them and rest assured this will be sorted out over the next two weeks. Could your daughter afford the payment is you were forced into this?
