I was told that the OR will be looking first and foremost for their fees. It does seem to be different in different areas but the IPA amounts are fairly standard. If you have bills that you can prove then its fact and must be accepted as such.

Hope its all sorted for you guys really soon, dont give up, ever. Your far too precious to your kids.

I have had a worrying day but I do feel a bit better now, I am trying not to stress too much about it!

I have decided if the OR pushes for the £100 IPA then I will not agree to and it will have to go to court for an order to enforce it! I just would hope the judge would be reasonable, but its another stress and battle I could do without right now!!!!!!!

Does anyone know of the procedure for this, an IPO as opposed to an IPA??????

Hi Jane, as far as I'm aware, if you do not agree to the IPA agreement then as it states in the letter I received :-

"Failure to return the form or contact the Official Receiver may result in an application being made to the court for an income payments order. If such an application is made you will receive notification of the date of the hearing, together with a copy of the application and the Official Receivers report to the Court"

So basically if you don't agree with it, and the Official Receiver won't budge, then it goes to court and you'll probably be given the chance to explain why you don't agree with it. They could put an earnings order in place for your hubby, but I think the first step would be to contact your OR and ask to review your income and expenditure - explain you cannot get benefits, so what you have coming in on your hubbies wage is the total of your income. Once you have gone over it all again, if he still insists on an IPA, I would suggest putting your arguement in writing and addressing it to the person who is above your OR. If this still doesn't work then all you can do is wait and have your day in court. Hope you're feeling a bit better today, I know how stressful it all is (believe me - I'm having major crisis - they want £350 a month off me and my surplus is about £2!), but just take one day as it comes. You've come this far - so just be positive and see it through to the end.

Hi jane hope you a feeling a bit better

Please try and keep your chin up, BR is worrying enough as it is but I understand you must be feeling under a lot more strain with the added worry of this scenario.
Please put it all in writing to the OR (not the assitant OR who is dealing with your case) you can find out who that is by searching for your local office on the insolvency web site and the name of the OR will be listed too.
You said they initially told you there was insufficent funds for an IPA did they say what they had calculated your disposable income was at the time?

I would include that in the letter too.

They did not say at the time about what they had worked out, on Monday, they just said no IPA as there is insufficient surplus.

Then I got a call on Thursday saying they cannot calculate our surplus until they know what benefits I can get!!!!!!!!!!!!!!!!!!!!!!

Another area of concern is my prescriptions, I get 4 items per month, OR told me not to allow for paying for these because I am on benefits, BUT I AM NOT ENTITLED TO ANY AND I DO NOT GET ANY BENEFTIS! Aaaaaaaaaaaaahhhhh
I have told him this.

So my dilemma now is, what to I tick on the prescription next time?? I do not work and get no benefits but I cannot pay for them? What do I do???

Now my dad has emailed me, he wants me to visit my dying stepmother this weekend, and I cannot afford the petrol! Its about 40 miles away, God, what a mess, dunno what to say to him as I have not told him, he has enough problems!!!!!!!!!!!!!

As far as your presciptions are concerned put that in the letter too and confirm you are not entitiled to free presciptions,

Really sorry to hear about your step mum, and I understand you not wanting to tell your dad, am sorry, if I had the money for petrol I would give it to you. not much use i'm afraid

I am sorry Jane, dont know what else to say, I just hope that you can get through all this, thoughts are with your father at what must be a desperate time for him.

I would certainly be willing to donate towards travel costs at this terrible time. Admin how do I do this?

This really does bring out how much suffering there is ..
we are constantly appalled at the stress so many of you are having to put up with day and night, and truely inspired by the level of help that is so generously being offered by forum members every single day...

Thanks to everyone on this forum for their help over the last few months, dunno what I’d have done without it!

I thought bankruptcy would be the end of our problems but it seems to just be ongoing!!!!!!!!!!!!!!!!!!!!!

I thought at least in bankruptcy, we would be allowed a normal standard of living but I feel we are being punished for our mistakes! I thought bankrutpcy would be a chance to start again without having to struggle, its struggling to make ends meet over the years that got us in to debt in the first place, now it seems the whole vicious circle will start over again, as we still wont have enough to live on!!!!!!! Wouldn't be too surprised if I got BRO too!!!!!!!!
