I didn't get called at work until a month after approval. Problem is, what can you say when everyone can hear you? It's kind of obvious what it's about! I refused to confirm my identity and they carried on talking. After that I told them I wasn't in and they left a message with me to call them. It's a good job the message was actually left with me and not a colleague!!
It took 4 months for it to stop, this was only after I'd taken the calls at home and explained a few times and I'd sent the chairmans report to them.
I'd advise getting them to remove the number ASAP.

In my book it's harassment, pure and simple.

The law defines harassment as contacts likely to cause 'alarm, distress or humiliation because of their frequency, publicity or manner.'

Whether or not you can do anything about it is another matter, but I'd be getting a (very) stiff letter in the post.

Harassment is a criminal offence.

Lots of waffle about this type of thing in my blog.....

Hey go for broke - why don't you prepare a Debtor's Guide to Harrassment and what to do?

Well David, I was well on the way to that (or something like it) in my blog, but then unforunately life intervened, such as the need to earn some money to eat!

I've a bit more time now, so who knows. . .

I think Melanie has a copy of my standard anti-harassement letter.

Still need a proper job tho !

In what area of the country do you live?
What type of work are you looking for?

Hi David

I'm based in Oxfordshire fairly close to Oxford.

Short answer - 'anything'

The sort of work I'd envisaged doing would probably be 1st line debt support/counselling, possibly on a part time basis (min 30 hours a week), ideally working from home.

Or any debt other related support/research/writing/analysis/ that would enable me to keep my 'projects' going and may well cover similar areas.

I'm currently training with the C.A.B to do advice work, which I'm hoping to complete by Christmas, so I'll be well versed in counselling and interview techniques.

In order to fulfill my obligations to C.A.B and another local charitable advice service I work for I need to be around here at least 1 day a week but other than that I can be flexible to a certain extent where I go, I have got relatives in the Manchester area for instance.

20+ years I.T. experience.

Best Regards, Simon

Hi go for broke i so agree with you, harressment and bullying has many guises and this is one of them, wearing people who are already vulnerable down to the point where they will give in and constantly phoning at work, yes they have a right to getting their money back but they do not have the right to constantly apply pressure and undue stress on anyone. I think that would be an excellent idea David having that on this forum it would stop a lot of unnecessary duress for those people that having what can only be called nuisience calls, did i spell that right?
Om shanti, namesté, good luck to all who are embarking on the IVA journey, it isn't always an easy one but the outcome is the best.

IVA COMPLETED August 2012, received Completion certificate 18.4.13.

I believe you are entitled to request that all future correspondence be dealt with by letter. If they ignore that they are breaking the law (telecoms act)
Completion Certificate received September 2012.

Hi All

Yes there is a whole raft of legislation which potentially deals with this, some of which I think has aquired the status of 'urban myth'.

For instance one which is often quoted in this context is the 1949 Wireless Telegraphy Act which has actually been repealed.

I think the main ones now which potentially apply (as Angel mentions above) are the Telecommunications Act 1984 Sec 43 and the Communications Act 2003 Sec 127 also the Protection from Harassment Act 2003?.

The 1970 Admin of Justice Act is the one usually quoted because it is the only one which specifically mentions debtors.

A lot of the problem with this is not the technicalities so much as what anyone will actually do about it.

However I have recently got hold of a very interesting Police document which I will be having a very good look at and if I find anything useful I will post it.

They didn't take any notice of me when I said I didn't want to deal with stuff on the phone, I would only deal with it by letter. They were told several times, but still kept phoning (not that I answered them!)

I think thats a classic example of the theory being one thing and the reality quite another.

i was very worried about creidtors harassing me at work so i called them all on the weekend and advised them i needed to update my contact numbers and removed mobile and work numbers from all creditors files- no questions asked as they dont yet know about my iva proposal (letters have been sent since then so they probably do now!!) it wa son the advice of someone on here and i feel so much better knowing they can only get hold of me by housephone- which i dont answer and doesnt have a message facility. they will be forced to write to me :)

An interesting tactic Rochelle, but I am sure that they will have kept details of your earlier nubers as well.
