Hey, I wasn't to sure where about to post this, so I thought I'd go through here, The search feature of the forum don't seem to be working..
So.. I have a slight problem.. I've been in my IVA now for 4 months, and I have had continuing problems with one company.. LittleWoods or also known as Nationwide Debt Recovery (NDR) I've had continuing letters requesting payments for my account with LittleWoods. I have sent basically 90% of these letters and I'm talking about 10 so far to my IVA supervisor who has wrote letter apon letter to these guys and still today.. What do I get.. another letter from them.. What is my best option here.. I've had one letter saying that bailiffs will be sent round if I do not pay up by the 12th September. I've read somewhere on the internet that these people are a right bunch.. as in they pretend to ignore letters sent to them and do not sign for recorded delivery and just keep on with the notices.. this can't be right.. surely?!

Help.. Starting to worry!

Darren, Til wrote a brilliant letter the other day, you need a copy of it but I can't find it now, maybe she can post it again. It dealt with your problem. What a nightmare for you. X

That would be great if someone could find it.. Like I say, the search part on the forum is playing up.. Many thanks if anyone could find this again for me.. Yeah, it is a nightmare, but then, it can't always be smooth sailing I guess..

Darren, I imagine the threat about the bailiffs is just that - a threat.

They cannot do anything to you at all.

I would possibly copy the front page of your chairmans report with the court details on and hand it to anyone if they did come to the door.

Haha. Yeah that sounds like a good idea, Cheers Kallis..

I did read a while ago, that Bailiffs do require a court order before they can be sent out, but then, surely the courts hold record of my IVA, so I hope I assume correctly that, that would be as far as it could go? I did wonder this before my initial message, but obviously.. I'm not to clued up on these proceedings..

You could possibly phone them, and tell the person on the other end of the phone to check the Insolvency Register. Once they see your name on there,that surely should confirm it (unless they are thicker than they appear!)

That is a good idea.. I did not think of that.. Yet again.. I did not think I would be receiving all these letters after my supervisor had wrote probably 3 letters to them so far.. I will do this in the morning.. See what happens.. Thanks for your advice, its very appreciated

Hi darren,

Here is the letter I wrote to Barclaycard who are so thick they phone us every day even after admitting they can see we've repeatedly told them about IVA!

It has been so nice having your constant telephone calls lately, however this aside I feel I must now advise you in writing (since telling you over the telephone proves fruitless) that I am now in an IVA and have been since August 7th 2008. You may contact our Insolvency Practitioner to confirm this or you could simply look up our names on the Insolvency Register therefore saving yourself a fortune in telephone calls to us!

I must add that it seems strange that you apparently know nothing of our IVA since not only have you sold our debt on to Eversheds who are perfectly aware of the IVA but you also voted YES to our IVA proposal! Alas it seems you just prefer to speak to us all the time despite all this – we are very flattered. However, since you are not permitted to contact us whilst we are in an IVA please ensure you update all your details to show that we are now in an IVA so as to avoid any further issues as we will no longer be taking your calls.

You shouldn't still be getting them, but some of these companies seem to have a problem with letting the people at the bottom know that it is ok to stop phoning.

Haha, that is a great letter, thanks again.. If this don't stop then I will have to write something out like this myself, certainly gives me a good base to start on if this carries on..

Good luck getting this sorted Darren. Littlewoods are basically thick - I was in an IVA and then I went BR and still they kept writing and phoning. They finally went away after I sent them another copy of my BR order, despite the fact the OR had already done it twice!

If you lived close to their offices, you could go round personally and kick up a stink until they took your name off their records![:D][:D]
