default notice Please help.

I have received a default notice. Amongst other things it states that I may get a visit. I hate these letters but since my house is like an explosion in a nasty letter factory, I am gradually becoming immune, however the thought of goons knocking the door is just too much and I am not sure what power they have. I have been advised not to let them in but what happens if I just do not open the door? I am freaking out.

I would try not to worry Freelilli, it is standard procedure when there are arrears on payments. Creditors have to do this first before they can start any legal action, but im assuming your already in the IVA process?

Expecting mine any day too!!
IVA in 2007 - failed in 2008.

Have just managed to get through to money advice and they said, creditors oftern say this but rarely does anyone call. Just have to wait and see.

Not in an IVA, rejected because I lost my job. Going bankrupt in January. Will be so releived when its all over.

A default notice gives the lender the ability to start full legal proceedings.

No collector has the right of entry to your property and if they attend your home (normally doesn't happen) tell them to go away politely simply stating that you are not prepared to discuss the matter (Firm but polite if you can). It depends on the lender but the majority will simply use the courts to process.

Don't hide away..... simply tell them to go away. They will then refer it back to the lender.

Just the phone calls upset the children, so I really hope they dont visit. My children pick up my stress really well, although I do try not to get too down about my situation. I have written to all creditors stating that I am trying to sort it out and the calls have reduced. Thanks for your advice I will do as you say, I have to force myself to face another day of this, I cannot wait to get something sorted.

Thanks to all who have offered support, I dont know what I would have done without it.

debt collectors do not have any automatic right to entry as far ias i am aware.

Hi
Only a baliff with a court order can enter your home, so stop worrying now.It is all standard procedure and most people will receive a default notice whilst sorting out an IVA or bankruptcy.All your letters and calls will stop once you sort your bankruptcy out.
Relax and try and enjoy Xmas as best you can

i agree lily try and relax, we have struggled so much the last 5 months in hope of the iva.

I am usually quite up beat about things, I cannot change whats happened, am trying to look to the future. I have only missed two months payments and I havent been taken to court.

I usually trudge through the post, have a sigh and get on with the day. Every now and again I reach saturation point, and freak out. This forum is my only scream out.

I really feel for you Kerri and wish you the best of luck.

Yes we have to stay sane, these are bad days in a new life, but we will get there. We will be having a couple of days where there will be no post, phone calls or harrassment. Fantastic.

Dont worry too much over the default letters I had hundreds of them, also three companies were going for CCJ with me but used the 28 day hold off and by that time the IVA proposal had been sent out.
Also had a spotty herbet sent by Egg turn up after the IVA had gone through just told him to b*g*er off.
