Hello,

At the start of my I.V.A application I was told that it would be in confidence.

After my I.V.A has now begun I have been told that all my details are on the Insolvancy Web-Site.

Where do I stand legally as I have been misled ?

Hi Nokia

No yoyu have not been misled - although your IP obviously did not make you aware that your IVA would be registered with the Department of Trade & Industry.

This is a statutory requirement, and a small price to pay for getting yor creditors to accept a reduced repayment, I would have thought. The register is rarely accessed by anyone other than insolvency practitioners, so I would not worry about this.

Just to add that it is extremely unlikely that anyone other than you will know of your IVA.The insolvency register is little known about outside of the industry.
If you were subject of a county court judgement and walked into the court on the day of your judgement then your name would be on a board for all to see.
Relax and just start counting down from 60

Hi Nokia

One of the things IVA salespeople mean by 'in confidence' is that an IVA will not be advertised in the paper as it is in Bankruptcy.

However they omit to mention it will be on the Insolvency Register alongside all the Bankrupts.

So I think you have quite probably been misled, but I doubt there is a lot you can realistically do about it.

I do not think that you have been misled,after all your employer does not know and if you have a partner they would not know unless they have an interest in a property that you both own.
