Hi Liedto,
Your story sound eerily familiar, I have a similar issue with my wife who has hidden debts, redirected post, forged my signature etc, etc to get credit, hide debts for almost the entire 17 yrs of our marriage. The financial part should have a black or white solution (I hope), but its pretty hard to get over the deception.

sorry to hear about whats happened, maybe he wasn't lying for callous reasons but for out of a feeling of shame and self delusion?

You are both in my thoughts and hope all goes well.

Hi,
Sorry I haven't been around, I had some awful news. My solicitor has committed suicide. I just can't believe it. He had helped me quite a bit, he was the second or third I went to and was lovely. Seemed so strong and together. I feel so bad. Now I need to find another one. Could anyone help me with the following? My husband has been advised (Grosvenor Partners LLP)that he can only get an IVA by remortgaging our home (due to the amount of equity in the property £300 - 400k)for £500k (current mortgage is £300k) as I have said I won't remortgage he has been advised he could sign the property over to me - via a solicitor also stating that the £200k is his debt. All his debts would be paid. Does this sound right? Would this still be an IVA? Our house is on the market but he really seems to be trying to get things sorted out and wants us to not split up because of his stupidity. He looked into this before but the mortgage co. seemed to be wearing masks, Grosvenor say they can find a suitable mortgage lender.

At least if he signs the house over to you there is nothing else he could guarantee against the house!

Hi
If you can remortgage and raise enough to pay his debts in full then there is no need for an IVA.
Find another solicitor and take further advice.
Also Mike from Leybridge[one of the forum experts] may be able to give you a second opinion regarding remortgage

I have been watching this post with interest since I joined the site, I wanted to wait to see what the other experts had to say especially in relation to the actual ‘going for the IVA’ advice that you would receive.

I am VERY concerned, as will the FSA be, that an Authorised Person (AP) is in such financial dire straits, and chances are; should the FSA get to hear of your husbands situation he will be removed and be unable to give advice.

Please, feel free to phone one of my advisors anytime to talk through your situation, they will take you through a complete fact find and will be able to ascertain whether there are any affordability issues and advise you of any mortgage products that will be suitable for you. Our mortgage processors are very skilled and experienced in dealing with courts and lenders where suspended or repossession orders are in place.

Am I missing something here - your husband signing the house over to you - how is he then going to raise his equity share to pay off his creditors, and do you intend to sell the property?

Hi everyone,

Well now my husband has gone for £194k 2nd mortgage to pay off his debts the apr is 12.5% total repayable £650k over 25 years. Nothing has been signed yet. He has no other choice but to go for this loan as he is unable to get a loan with a reputable company. He has been dealing with Grosvenor Partners Wealth Management Ltd and the loan is through loanmakers. Our house is on the market but we have had zero interest. We have around £300k equity in the property. Our original mortgage is with Cheltenham & Gloucester and that will carry on as normal. If I don't sign the documents he will have to be declared bankrupt but believe me I feel in no way pressured but there again if I don't sign we lose the house and I lose all the money I've worked for and put into the deposit. I can't face starting all over again.

Phew Liedto - that is some APR - Please take my advice and get a second opinion - I know Swift VERY well, we use them as an absolute LAST resort and I don’t believe that your situation is quiet that bad.

I would contact either Mike or Welshboy from this forum as 12.5% sounds extortionate.
