I split up with my Wife and managed to hit Lloyds and Amex for 36k. Not good. Started an IVA for £295 pm but I couldn't pay after a few years, so I run away to Spain after having a breakdown. I came back with nothing - homeless. Me and the cat (who I took with me) living in an old Volvo estate. I had never been so low. After 6 months of finally renting and getting back on my feet the Bailiffs caught up so I got another IVA. Both IVAs were from DFD. 3 years in paying £300 pm I lost my job so I religiously paid £100 pm and never missed. 6 months before the 5 years were up DFD did a review on my income and said I could now afford the agreed £300 pm even though my figures said no. I paid the £300 for a month and I had real difficulty managing.Then I got a letter from DFD stating that I had to pay this for a further 2 years. It was impossible so I carried on paying what I could which was £100 and 3 months down the line my IVA was declared void.
I consider this due to the fact that DFD charges were so extortionate they couldn't make any more money out of me so dropped me like a hot brick. I should have been told from the beginning to go Bankrupt but DFD seen £ signs when they knew I could pay £300 pm. DFD do not offer Bankruptcy deals. I have complained and the jury is still out.
I now await the dreaded Bailiff to knock as its been 2 months. My health is suffering again. Any help or advice gratefully appreciated.
You should seriously consider bankruptcy as a third IVA does not sound like the correct advice to me. It can be done online and very quickly and that would stop all legal action against you. Try your local CAB who could help for free.
The simple fact is, if the figures were correct and you could afford the £300 by living to their budget, that by paying £100 instead you were breaking the terms of the agreement and it has fallen void under the terms and conditions. There is really little you can do about that. A complaint will do little now as DFD are in administration.
You do not need an IP to file for bankruptcy which you can do yourself online.

Sorry about your problems but you would have to pay fees which would have been agreed at the beginning.

When I was in an IVA with DFD I paid half my monthly salary over which was £338 .when my second job had to go because I had been diagnosed with epliesy so could not drive. My income dropped by £170a month and I was onmedical leave for a year until I was correctly diagnosed and put on medication that stopped the fits and in this time I was living at home with parents and during this period my mum passed away with cancer which ment drop in money coming in for me due to ill health dad a pensioner and no pension as mum had died and having to pay household expenses between us . DFD didn't give a damn my payments stayed the same with my dad supporting me as I only had around£200 to live on and contribute to pay household bills . I'm glad they're in adminstration my father should not have been expected to have this burden for nearly two and a half years and at no time did they respond to lowering my payments which made a made stressful time for me more than it should have been out of £34.000 paid in which includes ppi only £12/13000 got paid to the creditors after all the fees etc were taken . I wish I could have used this forum then I've never been so low and struggling with no support from DFD good riddance!!!!!!

DFD accepted the £100 until my employment issues were resolved. I did not break the agreement at that time.

Yes true, but does anyone understand this - all anyone wants is an immediate solution.
I only realised how extortionate they were when they sent me a breakdown of what they were about to charge me for the expenditure review and charges for the next 2 years.
