Just a quick update, dfd rang me last thursday to say after creditor meeting iva has been agreed to complete, I was so happy and relieved as this has been 7yrs now! I then got a phone call today to say that dfd are going to have to fail it due to me not providing Mums bank statement as proof of my F&F £1500 payment! As those wh o know me already know mum is in hospital after a second stroke so I can't worry her with this! She sleeps 90% of time anyway:( gutted! Had to agree to fail!

That is absolute bunkum --- Speak to your IP and try to salvage the IVA.

Ridiculous and immediately my advice is to speak to your IP and seek their help - there is no need for an IVA to fail based on this in my opinion !

7 years and they're going to fail your IVA for not providing a bank statement?? incredible, try and contact who Foggy mentions above and I hope this is sorted for you very soon, you do not need the added stress of this alongside your mum being so poorly.
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

I have tried to speak to IP and he's never available and the people who ring me say what happens next is down to them as they are acting on his behalf and they have instructions from him?[xx(] Don't know how much arguement I have left in me! Just got back from visiting mum in hospital and once again perspective slaps me in the face. Concluded that I will have debts forever but not my mum. Thanks again for all your support. It really means a lot and a problem shared...... X

Call them up and tell them that unless he talks to you there and then you will be going to the insolvency service to complain about him personally and to the financial ombudsman regarding the company and to the local press..

and if he is not there instantly do all 3, make their life difficult.

The IVA should not fail because of their incompetency.

Also call the guy foggy mentioned and ask for the name of the senior partner / director of the company, then complain about him / her as well to all 3 mentioned above..

Dfd cannot trace my F&F payment and insists that I have to send them another duplicate bank statement as they have no proof I paid it. I have explained to them time and time again that I cannot access mums statements and that as far as she's concerned she has paid dfd and the IVA is all finished and I am not prepared to upset her with all this. They really don't understand why I don't want to approach mum and think Money is more important than my mums wellfare! I'm afraid she is much more important! Xx

Nichola.70, I'm sorry to hear about your Mum's condition.
Is there anyone with control of her finances who could get this information for you?
I assume from your last post that DFD are asking for proof of payment rather than proof that it was a 3rd party payment?
I hope you manage to get it sorted soon.

Nichola have you tried emailing your IP direct, the link above may find their direct contact details for you to email direct and hopefully that way s/he may look into your query and answer you direct. You should not be denied access to your IP, it is their duty to talk to you if admin staff cannot deal with your query satisfactorily. All the best.

Try emailing the experts from DFD who post on the forum ...this is so insensitive and wrong. Judith Anderton normally responds quickly ...she can be contacted via email to : DFDForumSupport@fairpoint.co.uk

More advice and opinions needed please! My iva has now failed and I want to know what may happen next? My iva was for 27k of debt, over the last 7yrs I have paid 17k into it and IP fees are going to be 5k. I am told that the funds are going to be shared out to creditors which meens a 30% dividend. My husband is not in iva and we are joint owners of our home with a hefty morgage. What I want to know is how long does it take to terminate? Are creditors going to come after me or force bankrupcy? Any ideas? I did try and speak to IP direct but was told it wasn't done and account management team had to deal with it. Apparently my majority creditor declined variation to settle with existing funds without mums statement being provided! :( Advice needed! Xx

I think that if I was in your position I would go through my mum's paperwork to find the statement. She obviously wanted to help and whether or not I felt good about doing it, I would. If it was the only thing stopping me completing after 7 years, it would be a no brainer. You need to speak to the IP. This is your life you are talking about. Did you get any response from their forum rep?

You don't need your Ip,I never spoke to my supervisor/Ip in five years.The management team will be suffice.Leave that for now.

The concrete substance here is the bank statement, avoid the distraction of speaking to Ip.....A dead end.He will say the same thing.

Creditors rejected the variation not your ip.He is just a messenger.


Unless you want another 5 years in a new iva and lose 5k of payment.

You can still fix this???...think and move forwards.

Thanks for your response. My mother doesn't have statements(paperless). I would need to request one from her bank and I haven't got power of attorney. If it was just sat in her home I would have got it. When mum was better last December we went to the bank and got a copy but IP never received it apparently and I can't prove otherwise! I told mum that was the end of it as she was horrified to think her money has gone and I still have iva! Cheque was cashed 17th Sept last year:( I send everything recorded delivery now but too late for this.

I have emailed DFD contact for you and asked to log onto the forum and take control of this post. Hopefully they will.
In the meantime I would seek their complaints process and put in a formal complaint now.
