Hi ,Still not had any reply off Dfd towards,hubbys variation,lost documents, and the fact that we are 2 mths behind in payments ,due to a cock up and bad information given to us by Clearstart.( Dfd have told us that we have had bad information by the way not me personally) We have had no time to save our contingency because of things breaking down and going wrong . Two new tyres for car last week =£85.00 Car tax this week =£102.00 Trip to Leicester Hospital for daughter (who is disabled) see a specialist (EXTRA PETROL =£35.00 . My hubby is working 60+ hours some weeks just to get by .I am by no means looking for sympathy just wanted to off load my worries as i am so depressed at the moment and things are not getting any better. Any advice ?xRachel
Also got our iva payments due in next week as well !!! not looking to good again this month paying total amounts either.Have just rang Dfd to tell them we are still struggling and they have said that if we dont pay our full amounts this mth then its classed as unauthorized at thats our choice and our fault if we have got further behind ! I simply give up with no help and support being given what are we to do .Its like they want us to fail .Is it possible to fail this iva and try again with someone else .?

I'm shocked at the way you have been treated Rachell, I don't know what to advise. Maybe you could give Paul Johns from Reviva a call, he sometimes acts as intermediary(sp!) so he may be able to help you sort it out. X

There is the 3 months default rule all IVA operate under so DFD are just citing this.IVA is suppose to get the balance right between expenditure and income.....and the IP is that ajudicator with creditors as 'Nero'

The extra expenses cited - if £50 was your contingency then that has wiped off 4 months of emergency 'savings'. Contingency should be £100 a month with the CURRENT ECONOMIC CLIMATE>>>>HELLO DO ANYONE READ THE BUSINESS PAGES THESE DAYS,ESPECIALLY CREDITORS ON YOUR TOMFOOLERY ANTICS in making money <<<<<

Hi ,Our contingency is £100 but since we started our iva we havent been able to save any because we have had so many things go wrong, car breaking down ,moving house etc,fridge freezer.We just havent been able to get really going in our ivas because of this and the increase in everything has made it worse. I am taking my daughter to hospital monday so i have that to worry about, shes disabled i am just wondering wouldt it be best because im getting no joy with dfd to either fail this iva and do another one later or to just go bankrupt. We dont own our house its council rented and we dont have any assets. We own a car but its only a m reg mondeo and only worth £500.Our joint debt is about £55000.

Hi Rachel

If your current IVA does fail, then you can present another one with an alternative IP - but I would hope that it does not come to this. I really feel that it is time for you to e-mail your IP directly and advise him that unless he can arrange to meet with you to discuss the future of your arrangement, then you will have no option but to seek guidance from his/her regulatory body.

Can you tell me a little more about your IVA:-

1 When did you start the arrangement
2 How much are you paying each month
3 What are the reasons for missing the payments
4 How much do you feel you could afford to pay, were the IVAs to be varied

Hi Melanie , Firstly i saw your interview today with Andy that you did and you sound a lovely person ! (wish we had found you first )We started the iva in jan 08 . We were paying me £160 hubby £248 We have always spoke to Clearstart with every problem we have had ,kept them informed.FEB 08- Our car blew up as previously posted , needed a new car . Got one off ebay ,nothing flash just m reg mondeo . Clearstart knew all about this .March 08 Fridge freezer went bang , again told Clearstart that wer were having problems and they advised pay what we could afford.April 08 , after waiting 2 years plus for a council move due to anti social behaveiour we at last moved . Told Clearstart straight away but we had to pay for removal van .So our payment towards iva again not full amount . June 08 we asked for a review of our income and expenditure because of an increase in things . Sent it back to Clearstart and they accepted it and said they could do a variation on my hubbys iva not mine. Signed paperwork and sent off. Spoke to them 5 days later and we were advised to pay £160 on mine and my hubbys reduced to £154 . Ok we said .Dfd have now said that Cleartstart should not have lowered paymenst until variation was proposed and agreed. This however was not our fault we paid as we were told.We didnt know of the merger either and still to this day have not recieved any letter telling us of this.So as it stands we are currently nearly both 2 and a bit mths behind .Also MELANIE WE STILL HAVE HAD NO LETTER OR CONFIRMATION WHO OUR NEW IP IS AND WHEN IVE ASKED THEY DONT KNOW !!!!!!!!!!!!

You are being treated very shabbily, and I am going to ask Andy Davie if, on behalf of the forum posters which are affected by this transfer of cases, whether he would be prepared to contact DFD to see if we can get some headway on this point.

When Debtmatters sold their IVA cases to Grant Thornton and Payplan, the GT partners and staff went out of their way to keep clients informed of what was happening and set up a help line just for this purpose.

Let me have a chat with Andy to see what we can do. And could you confirm whether there was any reason why you were treated as individual cases rather than mutual and interlocking?

Thanks MELANIE, Im sure we were interlocking ivas. But Dfd did mention something about this when i rang. What should i do for this months paymenti have had to buy 2 new tyres last week £85 and extra expense on Monday as daughter is in LEICESTER ROYAL.Spoke to Dfd this morning and they were not very helpful said if we did not pay full amounts then they we would be unauthorized and it would be our fault if we went further into arrears ! Also car tax is due next week as well .

Pay them as much as you can afford, and send a letter off by recorded delivery, keeping a copy, to say that you are not happy with the fact that you have no point of contact within this firm, or knowledge of who the IP acting for you actually is, and that you expect him/her to make contact with you over the next 7 days.

Technically you will go into default and your IP will either need to call a meeting of creditors to determine their wishes, call a meeting of creditors to review a variation to the terms, or fail the arrangement.

Thankyou sorry for so many questions but you just dont get any answers from Dfd . Nice to know that someone is listening to us and wanting to help . Thankyou so much.If however our iva does get failed is it harder to get one approved second time round?

When you send off your payment ask for the contact details of your new IP.
I would also send off a fresh income and expenditure form showing your joint disposible income of £314.

Just to say i have also had no letter to confirm transfer from Clearstart to DFD. Heard nothing. I'm waiting for my 1st review and its 1 month late now. The only reason i know about the transfer is through this forum. I have been so pleased with how my IVA was going with Clearstart. Its a real concern for me too. Trying to stay positive but would be nice to be reassured.
