Suzanne, don't put any money into the account - this is not your fault. Like Andy says take it to the ombudsman, let the bank charge you all they like in the meantime. They have broken the DD guarantee and you cannot lose.

Tell them you are going to the Ombudsman. They have to refund, it's their obligation under the D/D guarantee!!!
Print this off and take it to the branch, see if they still refuse to give a refund....

Hi
Go direct to the Banking Ombudsman now.
They will settle with you,guaranteed,and make sure that you demand enough to cover your time and expenses.If you go through the Banks complaints procedure it will take ages

I have done a letter today to the BO. The charges have been debited from the account and its now o/d again and they are charging me £5 per day. I'll keep you posted. I hope they don't shut my account for complaining! I won't get another one anywhere else!

Well... the update is the bank won't give it me back. The DD guarantee only covers the dd payment, which as Legal & General have admitted is there mistake, they are required to pay me back. To conclude..the bank hopes this restores my faith in their customer service and resolves my complaint.......hey?? So I have been onto L&G and I now stuck in their complaints procedure (8 weeks to investigate), meanwhile the bank are still charging me and its up to £165 - for a £9.44 dd paid! Ridiculous I think. I'll keep you posted.

I have just had a look at the guarantee. It states

If an error is made by us or your Bank/Building Society you are guaranteed a full and immediate refund from your branch of the amount paid.

The 'us' obviously refers to whichever company, but it still states that they should pay you back.

There's a good part of the Mail on Sunday financial pages, Tony Hetherington investigates things like this.

Wouldn't hurt you to write to him and see if he can help (there's probably similar things in other papers as well.)

If you haven't already then you must complain to the Banking Ombudsman.Your bank has a duty to refund the money and the power to claw it back from L&G
Please let us know what the BO says

You do need to complain to the Ombudsman, they cannot and should not be allowed to get away with this.

Result - I hope - L&G have agreed to refund the amount taken together with all bank charges and the money should be in my account by Friday.
So much for my bank eh? I have transferred all my dd's and my salary this week to my other account with Barclays. Happy Days, thanks for your help everyone x
