Does Disability Living Allowance have to be included as part of monthly income when applying for an IVA?

Yes - this is part of your income which is taken into account.

Don't forget to offset any additional expenses incurred against the DLA.

Thanks Melanie And Skippy,

My wife gets DLA of £432 and we're entering into a joint IVA. I am in full time employment and I am also her carer, which I of course do not take any money for.

She uses taxis to get out at a cost of £40-£50 a week; without this she would not be able to get out at all - some of these are trips to the doctors and hospital etc.

Do you know if this expense would be allowable?

Are you not able to claim any allowances for acting as your wife's carer?

Your IP will need to carefully explain the taxis, but I feel sure that they will be allowable within an appropriate proposal document.

Thanks for such speedy reply Melanie,

I wasn't actually aware that I could claim any allowances as I am also working. Do you have any ideas where I might find this information?

I would suggest the Inland Revenue's website as a starting point - but the CAB also give very good advice with regard to claims.

Hi Patrick and welcome

I have two disabled boys and I claim carere allowance but I am not working at the moment. When I was working I couldnt claim as I was earning too much. Anything over around 90 pounds per week and you wouldnt qualify.

I doubt you would be entitled.

Good luck with everything and make sure you put the extra cost of living with a disability down, it might suprise you, it certaninly did me.

When you say about putting down details of the extra cost of living with a disability, and that you were surprised-was your surprise at how it affected the outcome of your IVA?

Hi Patrick

I have two lots of DLA coming in and I was able to cancel I out by putting down all the extra's. I was suprised at how much I was spending extra that a family without disability wouldnt spend. Its important to maintain quality of life and those extra things are so important to ensure this, then of course there is the unexpected, like hospital stays etc. I had to leave my job and was unable to proceed, I am trying to negociate a settlement directly.

I was also able to claim a little bit back on the council tax, which I didnt know about until recently.

Obviously you want to propose a viable IVA so you will need to get equilibrium.

Yes you're right, it's surprising how it adds up without you realing it.

I understand what you mean about getting the equilibrium right for the IVA, otherwise my application might fail if I'm not careful.

I'll look into any possible rebates on Council tax as well.

Council tax rebate is subject to having adaptations made to your home, I have a downstairs bedroom, its not much but every little helps.
