Hi everyone, well my husband finally got a call on his mobile at work today from dfd. When he called me to let me know his version of what was said was jumbled so i got home and phoned them my self. They are still sending us the breach order apparently this cannot be reversed. Does anyone have advice on this?
We have to pay extra each month to cover the missed payments, i explained that because my husbands wages were paid as piece work and his level of pay is erratic i would be uneasy about agreeing to a set figure each month incase we couldnt keep up with it, it would be easier us paying what we could each month apparently this isnt allowed.
Or we could have an extension on the end but this would be sent to a creditors meeting and incur extra charges on top (something we can totally do without).
Can anyone help us with some advice, weve paid £64 extra for January but may only be able to afford £40 or £50 this month, the last extra payment came from our food money it wasnt spare really. I,m so fed up and feel totally insecure with this company, their lack of contact, ill advice on our debt options, us ending in breach without warning. Are their any options.

P.s we were also told the reason we have not received or been asked to complete a review in January is because they knew we couldnt afford to increase payments. Surely we should have a review to see if we are struggling to.

Jill, I think that the problem you have here is your prediction for erratic payments moving forward. IPs cannot really allow IVAs to continue in a haphazard manner - indeed we do not have any discretion or power to allow this.

I do think that you have things to sort out with your IP, but I think that you should perhaps now also look a little closer at the benefits of bankruptcy proceedings which may in the long run be the kindest thing for all concerned.

thanks melanie but i didnt mean my full payments were going to be erratic we can afford the proper payments each month its not knowing how much we can pay extra each month to catch up the 3 months when i was laid off.

My apologies Jill - I must have misread the thread. In this case you should ask for the payments to be tagged on to the end of the IVA.
