Credit Fix finally (if reluctantly) approved the consent order written. Unfortunately, the judge rejected it again because my car finance had been put in the secured debt column (again, something I didn't spot - because I wasn't looking for it) It needed to be shown as unsecured even though it wasn't going to be part of the IVA. This was resolved by having a credit check done to prove that it is unsecured.
And... the consent order has finally been sealed.
It all came at a cost though... financially for my parents as the solicitor had so much trouble getting information out of CF, 3 months worth off delays and the stress made me ill.
But the house is protected from the ex and I can finally file for absolute on the divorce.
Not only this, but I learnt so much about my IVA and how it should work that I realise now I was completely clueless. I took the IVA in desperation in the midst of an horrendous breakdown of my marriage, my only goal to secure the roof over my childrens head. In hindsight, I wish I had understood all the finer points. I feel CF were really keen to get me onboard, but I've felt like I've been paddling with only one oar ever since! I have no faith in them and another 5 years is an awfully long time to be associated with a company who seem so totally incompetent. But this is where I'm at.
Which leads me to two questions which I wondered whether you could help me with;
1. Cross fingers I get to the end of my 7 years (7 as a creditor is NRAM and assuming circumstances don't change and I can't get re-mortgage.) When the final review is done do CF do one last years review, or do they assess all reviews since the start?
2. I've read on here, that even after completion the likes of CF can turn around and ask for extra monies should they think you owe it. Is this correct?
So glad you got it sorted in the end. but what a nightmare it has been.
CF will only look at your final review. If any PPI comes to light they can claim that but once you have finished, your money is all yours.

They will do a final review after the last anniversary (the end date) to check the final years income has all been accounted for. Most companies will also run over the previous reviews to double check that nothing has been missed. I cannot recall an instance of CF coming back for more relating to earlier reviews.

After they have issued the completion certificate they can only ask for monies that would have been due, if known about, during the IVA; PPI, an undisclosed or unknown inheritance, that sort of thing.
My opinions are merely that .. opinions based on experience. Always seek professional advice.
