DMP COURT PROCEEDINGS

Hi

I am just starting to propose a DMP with a third party company acting on my behalf. I am due an inheritance from my mother, who died recently. One of my creditors, to whom I owe very little are begining court proceedings against me. I cannot pay the balance they are asking for. I sighned data protection forms allowing third party to work for me, however many of my creditors state they will only deal with me, they pester constantly. What should I do?

A number of creditors will not deal with DM co's.

Legally they are not obliged to deal with them.

Firstly contact the company and make a reasonable offer to pay detailing your expenditures etc. This is pretty much what the DM co would do.

If the creditor prefers the court process then they are able to do so. If you recieve Summons paperwork make sure you complete form N9 (Part of the papers you recieve) with the same offer to pay. In essence providing the offer to pay gives no unsecured creditor preference then the court will order the claimant to accept the offer... make sure you make the payments and the creditor can do little more.

The negative to this is you will have a CCJ.
