Just read a recent post involving Clear Debt where size5 said that their phone calls are recorded. I think this is a good thing but I wonder if other IVA companies do so. I assume that anyone calling them is told this at the start of the call but my IVA company, PayPlan, have never said this. I’m not bothered either way, but I would be interested to know if it’s just Clear Debt or others.

Some firms record call and I believe legally they have to tell you at the start of the call. x

I think you're right - it should be mentioned in the speil at the beginning of the call.

Hi - our call was recorded when McCambridge Duffy called to tell us the IVA was approved.
We were told about this by letter prior to the meeting and also at the beginning of the call.

So long as they tell you I guess they do. I've told a creditor this before in the run up to my IVA!
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

If calls are being recorded the law requires that the caller must be told at the outset, it's then up to the caller to deicde whether or not to proceed with the conversation. If the caller isn't informed then the recording cannot be used further down the line and it's illegal for any company or an individual (if you're the one recording the call) to retain the recording for any purpose. I think though that the standard message is 'calls may be recorded for training and quality purposes, so unless the message states calls are, or will be recorded then it would be difficult to prove one way or the other if a call/conversation has taken place.

Speaking for ourselves, we DO record all calls. It is true that people have to be told of this, and they are, but in the end it helps to eliminate any doubt should any dispute occur.

When you are dealing with clients who are usually in a vulnerable situation, guiding them through this, and very much affecting their future in the process should they instruct you do to so, any less would not be acceptable in my view.

Regards.

We don't as a rule, but thankfully disputes of a "he said, she said" nature are infrequent.

Terry - feel free to record your feelings/dealings with an IP on here.

Someone will be along to assist.
