Just for the sake of clarity are we encouraging a bank employee not to tell that bank they are going into an IVA?

Of course I am not. The bank employee needs to be mindful of the contract they signed with their employer, and understand that they are bound by the terms.

My former bank trawls the Insolvency Register with a sophisticated computer program/link which identifies names and addresses on the Register and matches them with addresses held for customers and employees - I was told that by an employee of the bank.

If it says nothing in your contract, and your HR department don't insist on it, then I don't see why you should have to tell your boss - regardless of where you work.

I agree with that! I don't, however, like the Orwell syndrome which is creeping in everywhere these days.

When we did our iva I said If anyone at work finds out I'd rather quit and go bankrupt. Not telling anyone, still feel ashamed.[:(] Though I know its not all my fault.

Jan - you may know the answer to this; with solicitors their primary duty is to the Court as they are Officers of the Court first and last. Are not IPs in a similar position (I know their primary duty is to creditors) but IVAs are registered with a Court (I think) and the IPs verify and, I suppose, certify the documents and information as true and factual. Therefore, if a client tells an IP a deliberate lie in order to place him/herself in a position whereby assets are hidden from the creditors, would that not be an issue that would have to be reported to the Court by the IP? I believe there would be a case for Court intervention in situations like that.

Absolutely Skippy! Medical Records are a good example - all and sundry will be able to access them if the doctors do not win the battle over the data base this apology for a Govt wishes to implement.

I imagine that if a person tells a deliberate lie, or attempts to hide anything from the IP and the creditors, if it is found out, then at the very least it will cause the IVA to fail.

It could, dependent upon what it was, possibly involve fraud.

Thought so but I wanted an ex-copper to confirm it. As said elsewhere - it pays to be honest- fraud carries a heavy sentance.!
