do I tell the reciever

My Son gets dla and has it paid into a bank account, it was in my name but since he has tured 18 he now has his and my name on it, he has been taking money out and currently there is about £9,000 in the account, do I tell the reciever about this as its his money and not mine but as he has mental health issues i remain on the account.

Hi Dawn

Yes tell the Official Receiver about it. I believe that it is trust money, which is exempt from the Bankruptcy under Section 283(3)(a) Insolvency Act 1986 which covers "property held by the Bankrupt on Trust for any other person"
