I completed my IVA in July and sent my certificate of compliance to the 3 credit reference agencies who have updated my file accordingly.
On looking at my Experian file all my creditors have now updated to say 'satisfied or settled', apart from EGG and RBS.
I had a loan and a credit card with EGG and a credit card with RBS and they are both still showing a balance owed.
This in itself would not alarm me as they could just be slower to update their records but i have alos received an annual statement through from EGG whihc i have never had before stating that they have receieved a payment in JUly but i still owe them nearly 4k.
Are they allowed to write to me? What action can i take to get them to update my record and stop them saying i owe them money??
Hi Suzie, not sure on this one but one of the experts will be along soon who are in the profession and I'm sure will know the answer so will keep this bumped up for a reply. x
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.
Ive definitely no expert but i would of thought IF these creditors were part of your IVA..were they?? then they cannot chase you after its finished. Surely it would ben down to each creditor to obtain their dividend from the IP...like i saw im hardly an expert though
I have just had a similar problem with Tesco Finance for a debt of £21K. I settled my IVA via F & F earlier this year. I simply wrote to them when I received the statement and they conducted an investigation which proved that they had received a dividend and they are now amending there records. I would suggest you do the same and maybe enclose a copy of your completion letter.
They can't chase you for any money if they were included in your IVA.
You could try sending them a copy of your completion letter and telling them you have concluded your IVA, owe them nothing and you don't expect them to request money again.
