Hi,
Hope everyone is keeping well. Have just got back to the cold and wet after having spent a cheap week with my bro in law who lives in Turkey. Now it should have been a chance for my wife and I to recharge and look foward. But after many weeks with no contact from any of my creditors since my IVA was approved the phone calls started on my mobile from Credit Managment services on behalf of Natwest. I told them that my IVA has been approved and they were not to contact me but I was just told that they did not know anything about the IVA and they were starting and they wanted payment or else. So I ended up having to make lots of expensive calls to them and my IP to get it sorted out. Its strange that the calls started as soon as we left the country, perhaps we should not have had a holiday but my Bro in law paid for the flights and we stayed with him. Anyway rant over it was a nice week but would have been better without Natwest.

There is no problem with holidays during an IVA so long as they are affordable within your budget and do not affect your ability to make your payments. It is completely unrealistic for someone to think that they cannot take a break for a full five year period.

I would just have ignored them...at the end of the day you have an IVA in place so they cant touch you..they could have huffed and puffed all holiday...the problem is theirs now![8D]

Its a shame that happened to you on your holiday. I had a call from Mercers on Saturday night, I told them my IVA had been approved and they said they had no record of any IVA, I told them the name of my IP and the company name who dealt with my IVA and they said they would hold all calls for a week.
I told them that they could not contat me and moving forward I could not pay them anything. I know sometimes it will take a while for things to filter through.

Hi whichwaynow,

Sometimes it does take a while for certain creditors to filter the information through to the correct department that an IVA has been accepted (some are quicker than others). The person on the other end of the line probably thought you were trying to get out of paying etc.

I am now getting phone calls daily from these people. I have informed my IP but is there any thing else I can do as all they say is that they are not aware of my IVA been approved. My IP says that my chairmans report has been sent to them.

It is frustrating, but there is very little that anyone can do until the banks deal with their mailbox. Keep telling them that you are in an IVA and this will die down eventually.

This is extremly frustrating and the only thing that you can do is stand firm and keep asking each creditor to update their systems or contact your IP.

I had a similar problem with Mint, it took 5 months for them to get the message, they even sent 2 seperate debt collecting agencies after me, once I had convinced the first one that I was in an IVA a second company were instructed to come after me, these people are very persistent, don't believe a word you tell them and can become very threatening. At the end of the day they can't do anything to you as long as you keep to the terms of your IVA, I know it's hard but tell them very politely you are in an IVA and they are not allowed to demand payments off you, then send all their details to your IP and let him handle it, that's what he is being paid for.
Be patient they will eventually get the message.
IVA COMPLETED ON THE 17th MARCH, FINAL I&E COMPLETED 26th APRIL, COMPLETION CERTIFICATE ARRIVED 2nd AUGUST

I am bankrupt but still the creditor action continues, threats of legal action, etc.

I had some man at my door from Northern Rock yesterday asking me what I am planning to do about my old house and repaying all my debts!! Arrhhh

I know the OR has notified creditors TWICE now of the bankruptcy as N Rock (them again!) awarded us a CCJ and put a Interim Charging Order on the house AFTER the bankruptcy date!!!!!!

Its really intimidating getting all these threatening letters still!!!!! Its as if they just don't believe it!

I would have thought that NR would have more urgent matters to deal with than visiting people in their homes LOL!!!!
