hi all,hope someone could answer me a question.today i recieved a letter from a company called eversheds,working on behalf on max recovery.It states that i do no need to contact them,and they will prpbably never contact me.who or what are eversheds,and what can i expect from them.One of my creditors ge finance transfrered my debt to them,although as of the 28th my iva was agreed.any help would be most appreciated

Some of my OH debts were transferred to max eversheds (before and after IVA. they are very good and usually head there letters with 'this is not a demand for payment' which we find quite calming. They usually also say 'you dont need to contact us, we will deal directly with your IP' we have never had calls from them and no letters since.
In fact, when my part of the IVA got refused (due to 1 creditor) i was advised by my IP to wait until they sold to 'max' as they are very good with IVAs. Don't worry about it, they are far less agressive and more understanding than most creditors, and will go through your IP not hassle you. forward the letter to your IP and forget about it.

Thanks roller,thats put my mind at ease,and yes the letter did start with 'this is not a demand for payment'.Great stuff from the forum as usaul

Hi goneskint.

Max recovery bought a good proportion of my debts and when I came to offer a full and final settlement recently they voted very positively, in my favour, which meant that the full and final offer was accepted [:)]

they took about 26k of my 32k debts.. so far they haven't even made a claim.. Weird world.

I have had the same letter. We just passed it on to our IP

yes and the probably paid £2,600 for the debt so they are set to rake it in and they have 5yrs to make a claim

totally agree, but i can hope that my ip makes a clause at the next Annual Meeting that says they have 12 months to claim etc as others have had.

If they don't i'm on a RIGHT winner as the amount paid will easily pay 100% to the other creditors meaning refund time.

Not expecting it to happen but how good would it be to walk away with over 10k..

We all live in hope such incompetence can happen, it did at most of the companies i've worked at lol

i owed northern rock 42,000 they didnt even vote and after 2 years have sold it on, it beggars belief how they just write it off.[:0]

neither did barclays (the eversheds debt obviously)

Was chuffed that Melanie said if the IP makes a clause on timescales and they don't make it or the 5 year thing i will get back anything paid over 100% to all other creditors and fees.

Can't wait to see at my next report it they have bothered. Each one makes me slightly more happy .

If it comes off after 5 years i will come to a frugal friends and get the beers in on Barclays lol

Some IP's in their annual reports eventually give a condition that will say "any outstanding creditors have until dd/mm/yyyy to claim"

If they fail to comply they can be excluded from the agreement.

IP's should have sorted claims in the 1st year.. every one the creditors miss is one closer to losing out, helping you pay 100% to the others, anything on top in excess would be yours.

Hence i am going to pay about 22k into my iva including fees. THe creditors that have claimed total about 6k so i will easily be able to pay them 100p/1£..

Fingers x'd their incompetence lasts a few more years

they have to track me down on their records first hey . muahhahahahaha

just to show how incompetent barclays were they paid my £2000 bank charges back to me directly when i owed them and b'card nearly 20k

funny as f**k.
