Don't let Barclaycard bully you into anything! They are terrible for this, we had real problems with them, and got to the stage where we vetted phone calls and didn't answer the ones from them or Mercers (who Barclaycard usually pass the debt on to). They are just bully boy tactics and just ignored them.

hi - like others have said do not let these people get to you - i know it is hard but you are trying to sort your problems out, so just stay calm and firm!

they are just trying to frighten you! we had mercers on behalf of barclaycard ringing constantly and threatening all sorts - nothing ever happened.

there are plenty of people on here who will support you so keep posting, stay strong, keep yer chin up, in a few weeks this will all be behind you!

Just like others have said dont let anyone bully you. Youre certainly not the only one who is committed beyond your means, its a problem you are facing and thats all you can do. These people act like its their own money and its not, they are just trying to secure their own commission. They are only doing a job and scaring people who dont quite know where they stand often works. It takes a while to take you to court, the courts wouldnt take action on someone for missing one payment, they will only go to court if you refuse to pay, thats clearly not the case here.

It might be worth writing to them all and telling them you cant pay but are trying to address the problem via an IVA, promise to keep them informed and say youre not prepared to communicate verbally as the contact staff are very aggressive and uncooperative. This would certainly be evidence that youre not trying to escape paying and it would be hard for them to go to court with this evidence, but do post them recorded delivery. I did this myself and it really did help me, I explained everything and I knew I was doing my best, they couldnt argue with that.

Another thing you could do when they phone you is; write down what you need to tell them and just read it out, something like, sorry cant pay, going for an IVA, you will hear something from the IP (name and company)soon. Thank you. Dont get into an argument with them and dont be intimidated. Owing some money doesnt mean you suddenly become de-humanised although it can feel that way.

There are laws in place saying they are not allowed to cause distress or lie but they still do, the laws are there to protect you from stress caused by phone calls and lies etc. I made a complaint about one of my aggressive creditors and they soon backed off. I also wrote and told them everything including how aggressive their call staff were and that stopped too.

I know how hard this is, most of us do but you will get through it, just be insistant and dont worry about the threats of court etc. Be proud of yourself for trying to sort it all out, that takes guts.

Hi

These letters and calls come from an automated process and is part of their recovery system, it is very rare that these creditors put in doorstop recovery agents, infact a number of these debts are sold on and on. Once your IVA is approved these letters and calls will stop.

I can vouch for that, since our IVA last Monday, we only received one phone call, and that on the night the IVA was approved. It gave me great pleasure to give them the news! Since then, not one letter or phone call.

Should think so Ray! I just loved being able to tell Mercers that they weren't getting any money from me.

The paperwork arrived yesterday and i have read through and signed. My husband is going to read his part and sign that too. Then it will be int he first class post tomorrow!

I made one last creditor payment today but I will make no more - not even a penny from this moment on (until i find out if our IVA is approved, that is).

My IP Has asked me to enclose a cheque for the first payment (made out to me) so that if the IVA goes through They pay it straight into the IVA account that day. They also sent me a standing order form to fill in, which will be sent off if the IVA goes through.

Problem is I have changed bank accounts for a basic account (as recommended) and I do not have a cheque book – so I will need to let them know about that!

That's good Annie, things are moving now and by not making any payments it'll give you a bit space to breath. If any of your creditors ring tell them you are entering into an IVA and you can't make any payments until it's set up, be strong as they will try to get money out of you.
