I completely agree, Lisa. The only reason that springs to my mind is to dissuade the client from proposing an variation in the first place. As I said, another of the big boys is routinely refusing to even propose variations !

I would challenge this if I was the debtor. Unless it was part of the original proposals/mods I can't see how this is right. What right does the IP have to add in a variation of their choosing and contrary to the terms of the IVA?!
This was my feeling. I wasn't happy at all but they did remove it on request.

All - I can see that my dilemma has certainly prompted debate. In my situation where, as I have explained in this thread, I can pay in full but have several financial circumstances where I need to retain as much of my inheritance as possible, I was made to feel threatened by the bankruptcy mention. I had even been shortlisted for a job this week but was rejected at the last minute as I am in an IVA. My current job is at risk and I now feel reluctant to go for the variation option. After losing my father after a horrible and lengthy passing, this is the last straw. My dad worked all his life to leave his children a legacy and these so-and-so's are making what has been a traumatic year even worse. Thank you to all who have taken their time to help but the reality is I think I've had enough. My IP has not helped, made me think they are on the side of the creditors and out for their own gain and I feel as if I am between a rock and a hard place and now just want to throw the towel in and get on with my life. C'est la vie.

I agree. Do not give up and demand that variation as you have nothing to lose. If they mess you about make a formal complaint and ulitmately take it to the regulators.
Well everyone, I have bitten the bullet and asked for a variation meeting. It was a very hard decision to make but all of your support and advice made me realise that I can't lose anything by asking the question for waiving the statutory interest. I took on board all the advice you have given when speaking to the IP and I am now on the path to getting the meeting arranged. They are still saying it could take three months though. However when the "bankruptcy" phrase was mentioned again, I went in really strong to say that I felt it was being used as a threat and that I felt bullied into not asking for the meeting and I really felt that I got my point over and got an apology of sorts. Am now in the process of gathering together all the supporting documentation for submission to support my case. Watch this space. I'll keep you posted.
Good for you. Glad you stuck to your guns and hopefully the threat of BR will be removed.
