It must be very frustrating not to be able to speak to your actual IP. Sometimes I wonder who these people actually are - but they are highly qualified professionals, who are only here due to the fact that clients choose them to represent them, and to refuse to speak to a client is abominable.

Turning to your questions, bankruptcy is not automatic in the event that an IVA fails, and the money that has been paid into the IVA so far will be distributed to those creditors who are bound by the IVA - of course subject to any charges and costs which have rightfully been incurred to that date.

Which IP firm are you actually with, Skint?

Who is your IP? What they are doing is wrong and he/she needs to be sorted out (based on the facts as reported here by you. If you can tell me or email me direct I will have a word with him/her - what you have suggested as a full and final is appropriate and proportionate. Contact me.

Happy new year everyone.

My IVA is with MAZARS. They were passed my details by harrington brooks coming up to 3 years ago.

I am waiting to receive a letter indicating whether they will put forward the £12000 to my creditors as a Full and Final.

I am also with MAZARS, I also got a IVA with them via Harrington Brooks (see my mis sold post). Apart from how expensive they are, I have no complaints after 4 + years. But I have never been in a position to offer final settlement.

Is it Mr T Askham?
Not sure what happened but I am all paid up and finished...they even owe me money now :)))

Thank you for your post hammer. Yes The exact one. I tried ringing again on Friday but couldnt speak with him or the lady that was dealing with my case. SO I spoke to someone I had previous dealings with.

I didnt investigate other IP's at the time and I have read so many familiar stories on here.

With the contact that I have had with them so far it doesnt seem that I am going to get anywhere with them. But I will just wait to see what is said this week. They have said if I can offer 15K they will put the offer forward.

My family members have agreed to give me a gift of 8K, the student loans company have to return the money that they have been taking for the past three years which is around 2.7K plus the time from when I made the query I would have paid them a further £1215. That comes up to £11915. I can make that up to 12K rather than the 15K which they have asked for.

I was just amazed at them telling me the current ecoonomic climate is not reason enough for them to tell my creditors and the fact that I said I need to move out didnt seem to phase them at all.

I really cant continue like this. I need to move out and move on. Ive been living with family for the past 3 years and everyone is feeling the strain. Then their response was oh "when you move out, we can review it then." That isn't good enough.

I have been given a breach letter because I havent been paying the extra on top that the student loans have been taking out. This I have explained to them. I am also amazed that I had to sort out the student loans company myself. They have been taking money but then ask me to contact the loans company myself.

I think this week will be the final straw and I will determine what my other options are.

It appears to me that your IP is not behaving in a credible and proper fashion. Any further problems tell him/her you will be seeking free advice from another practitioner to review their actions or threaten to report him/her to his/her professional body on the basis of being "unreasonable" and not looking at appropriate solutions to your current situation properly.

I agree that you have been treated really shabbily skint.

I think you will have to resort to what David has suggested and hopefully anyone else reading this will give that particular firm a wide berth.

Thank you for your replies and your help. I will be contacting them tomorrow again regarding my current situation as I have been at work the last few days. Hopefully I can get this resolved as soon as possible.

You could also threaten to write to your creditors individually about the offer, which they are refusing to put forward which would be embarrasing, as I expect that the majority of the debt is now with Max Recovery who will consider any reasonable offer of early settlement.

Thank you for that Melanie I will see what they have to say to me in the morning. I just want to settle this and move on. Its been a stressful and trying time for the past three years.

My word, you have done most of the work yourself. Well done.
The calls you have made should have been done by your IVA Company, that is what you pay them to do.
Cannot believe it has taken them 3 years to discuss the Student Loan repayments, and how can they justify sending you a breach letter now, by the sounds of it, you probably should have received that before.
But again, the error wasnt made by you, but the IVA Company.
Any offer that you wish to put forward should be done, the IP or their staff cannot tell you what you must offer.
It is your name on the IVA and you owe the creditors, it is the IP's responsibility to get the best return for you and the creditors. You can only offer them what you have available, and the chances are, with the current climate, the creditors may well accept your offer and get whatever they can. Something is better than nothing as they say.
Good luck with the refund and the offer that you request be put forward to the creditors.
